Main objection to the Proposed “Marriage Laws (Amended) Bill,2010, 


We had already submitted our objection and suggestions to parliament committee, but the present law minister totally ignore the same and even tamper the original bill even worse by making new amended, so we request either make the law gender neutral and respect natural justice or roll back the same immediately as this will became a “extraction law” than giving any natural justice to people.



A. The Bill must be gender neutral, if a wife have contribution to husbands property( movable or immovable) , any property made by wife ( movable or immovable) also have husbands contribution, so only Even in USA-Txas law the word used "Spouse" instead of wife or husband, other wise one sided law will create a disharmony, increase of crime, huge litigation in court for property disputes.

B. The benefit of divorce can't be equal to married relationship , as the obligation and responsibility after divorce change to either spouse. Even in 2010 china SC also amended the property division law to belongs to the spouse who made it , as such law made havoc in court cases and people started use the marriage as property earning business than love or care to each others.

C. Proposed Amendment: 13D (1) Where the wife is the respondent to a petition for the dissolution of marriage by a decree of divorce under section 13C, she may oppose the grant of decree on ground that the dissolution of the marriage will result in grave financial hardship to her and that in all circumstances be wrong to dissolve the marriage…..

Our View:

Right to oppose should be given to both parties The word wife to be replaced by the word "spouse".
The line to be added: The Divorce degree will be awarded only when all other cases against each others had been quashed or withdrawn and in future no cases will be filed against each other spouse. Otherwise the basic purpose of this law to reduce the litigation will be defeated.

There are other provisions of maintenance HMA 24/25, CrPC 125, DV Act, adding another provision is duplication and a tool to harass the husband
Rampant misuse of this section to harass the husbands
As per 13C(2), if she is separated for 3 years, she would have already approached the court in case of financial difficulties.
Another attempt to extort husbands (as in 498a and DV Act).

Our Proposed: “The respondent to a petition for the dissolution of marriage by a decree of divorce under section 13C, may oppose the grant of a decree on the ground that the dissolution of the marriage will result in grave financial hardship to them and that it would in all the circumstances be wrong to dissolve the marriage. All cases pending, between the parties would also be quashed before granting divorce under Section 13C”..All case like 498A, DV Act and other litigations should be quashed before the grant of decree.”

D. Proposed Amendment: 13F and 28D:( Special provisions relating to disposal of property in proceedings under 13C)

Without prejudice to any customs or usage or any other law for the time being in force, the court may, at the time of passing of the degree under section 13C on a petition made by the wife, order that the husband shall give for her and children as defined in section 13E, such compensation which shall include a share in his share of the immovable property ( other than inherited or inheritable immovable property) and such amount by way of share in movable property, if any, towards the settlement of her claim, as the court may deem just and equitable, and while determining such compensation the court shall take into account the value of inherited or inheritable property of husband.

Our View :

The word wife and husband to be replaced by spouse which followed by all over world, even in USA-Txas the same is spouse.
If this law passed as per above, for example the wife have 1000 crs ( let it be given by husband also) and husband have only 10 lacks, but as per law, her 1000 crs can't be touched, but the husband 10 lacks to be divided and given to wife? This is totally injustice and against any natural justice System of the world.

The property accrued before marriage, either spouse should not have any right, as there is no contribution of other spouse on that, the contribution to be considered only on the property made after marriage and any claim to others property to be allowed if only the marriage obligation is more than 10 years.

So Our Proposed : 13F and 28D:( Special provisions relating to disposal of property accrued during subsistence of marriage in proceedings under 13C)

"Without prejudice to any customs or usage or any other law for the time being in force, in any proceeding under section 13C, at the time of passing of the degree , the court may on a petition made by "either spouse" order that the "other spouse" shall pay for "her/his" and children as defined in section 13E, as finciancail support such gross sum or share in the movable or immovable residential property towards settlement of property rights as the court may deem it to be just and equitable, "considering the duration of marriage" and any such payment shall be secured , if necessary , by change on the immovable residential property of the other party. For any claim each others spouses residential property, the minimum marriage duration should be considered as 10 years.

E. The law should be equal and must follow the natural justice and stop making assumption that all women born in Raja Harish chandra family and all men born in criminal family.

The person seeking Divorce on "No fault Ground" , should not get the same benefit , who seek the divorce by proving other party fault. A person should not be punished for "No Fault" in the name of easy divorce nor his/her hard earned accrued property movable or immovable should be garbed under any such biased law, which will create injustice and will create more disharmony in society which in result will increase the over all crime in India.

Sub: Save Family Foundation (SFF) calls for Peaceful Candle March in the honor yet another Martyr of Marriage

Morning Shocker:

It was a usual Wednesday morning to which Bangalore woke up, only to be shaken by the brazen news of a young man of 36 committing suicide due to alleged torture by wife leaving behind his 1 year old son, 2 married brothers, an old mother and an unfortunate suicide note blaming his wife and mother-in-law for the extreme step of ending his life. Techie by Profession, Manoj Kumar worked for Oracle, while his wife Pramila worked for Bharat Electric Limited.

Manoj has had a tumultuous marriage. Constant torture by his wife which reached unbearable limits as she forced him to stay away from his family under threats of getting him jailed under a false 498A (dowry) case led Manoj to write “Sorry Son” on his T-Shirt before hanging his body from the ceiling fan on the unfortunate night of 8th April 2013. This was after his wife abused his entire family, physically assaulted his brother with a helmet and tried to attack his old mother before she dared them that she would get them jailed in false dowry case if her demands are not met.

Manoj is not a solo victim but amongst lakhs of men who are abused daily in marriages and with this suicide, he enters the thousands of unfortunate men who die a silent death in an insensitive society that refuses to protect men.

Far Away in Dehradoon:

Manoj’s case is not very different from the case of Dr. Prashant Pandey of Dehradoon who committed suicide about two months ago as he was trapped in false cases and was not getting justice anywhere from the legal system. 55 days after he succumbed to the anti-male bias, his perpetrators roam free in the society while the Dehradoon DCP gives lip-service to his family.

Save Family Foundation (Regd.) comprises of families fighting against all laws that aggravate marital disputes; promote abuse of the elderly; violate basic human rights of men, women and children; precipitate family break-ups, facilitate the acquittal of the misuse of the law and promote a fatherless society. 

SFF recognizes such abuse of men is growing by the second and being exasperated, these men are committing suicides. These men are not dying; they are actually “Martyrs of Marriage”, as they lay down their lives at the altar of marriage trying to protect it from their vindictive, abusive, manipulative and greedy wives.

Having no law at their disposal to protect them and also fearing false cases being lodged against them under the various anti-male laws, these innocent abused male victims feel it’s the end of the road and take to the extreme step of ending their lives. SFF displays solidarity with the families of such victims and strongly condemns their deaths.

No Isolated Cases:
As per data provided by the National Crime Record Bureau (NCRB), every year more than 62000 married men are committing suicides and the number is rising. In the last 15 years close to 200,000 married men have committed suicide directly due to domestic violence and torture from wife as per the analysis of NCRB, a unit of Union Home Ministry.

A mark of respect for the Martyrs of Marriage:

On the Saturday, 13th April, 2013, four cities – Bangalore, Delhi, Lucknow and Kolkata – will rise for men as citizens will be participating in Peaceful Candle March praying for the departed souls of the Martyrs of Marriage demanding strict action against such women and their family members who abet the suicides of these martyrs.

The Address for Delhi Protest is in front of Delhi Police Headquarters (ITO).

Time: 6:00 – 7:30 PM, Date: 13 April 2013

SFF Demands:

1.       CrPC 41 Amendment should be strictly followed. Registration of FIR should be carefully done and Power of Arrest should be carefully exercised.
2.       Fair and Unbiased investigation of cases. Complainant’s claims should be diligently investigated and verified.
3.       Police should be sensitized towards issues of domestic violence faced by men. Proper Complaint redressal mechanism for Husbands harassed by the wife.
4.       The cases related to Suicide of Husband should be dealt with same sincerity as it is dealt with Wife’s Suicide.
5.       Suicide of Married Men is a serious issue (double the rate than married women) and the unfortunate incident of suicide of Sh. Manoj Kumar should be reminder to the system to improve its sensitivity towards Married Men suffering from domestic violence and threats of false cases by the wife.

Ban on Vishwaroopam is another form of legal terrorism claims Men NGOs.



Men’s rights organizations in India, under the platform of Save Indian Family (SIF), collectively, categorically and severely condemn the ban on Kamal Hassan’s movie – Vishwaroopam.

SIF, the umbrella organization of men’s rights organizations in India, working towards creating awareness of men’s problems, supporting distressed and victimized men, demanding gender neutral laws, protesting against misuse of anti-male laws, has termed the current ban on the movie Vishwaroopam as yet another form of legal terrorism in India, where democracy and right to free speech are becoming emblems of mockery.

SIF and its allied NGOs like Save Indian Family Foundation (Bangalore), Save Family Foundation (Delhi), Men’s Rights Association (Pune) to name a few, have a completely neutral stand on the content of the movie.

They neither support nor oppose the movie and its content and make a categorical statement of not taking sides with any party involved in the Vishwaroopam controversy.

1.      Having said that, it is appalling to see the failure of the Indian Judicial System in this particular case, as the think tank of SIF believes that the primary onus for the movie goes to the Central Board of Film Certification (CBFC) and if the protestors have an issue, if any, they must address it with the CBFC instead of filing case on the movie maker.

2.      It’s the onus and responsibility of the CBFC to determine which movies are viewable and which aren’t and what is the audience for a particular movie and if the CBFC has given the go-ahead to a particular movie, SIF sees no point in dragging Kamal Hassan into this controversy.

3.      SIF is also wary of the fact that partisan social double standards are coming up. If the claim of the protestors is that Muslims have been projected badly in the movie (if it has been done so), and hence they have a right to file a case against the movie, then where do these so-called socially active organizations vanish, when day in and day out, men are projected badly in almost every other movie.

Due to such bad portrayal of men in movies, society has become insensitive to “Violence against Men”, as a result of which, violence and crime against men never become social issues. Added to this, such portrayal of men creates an atmosphere of gagging against men which suppresses their problems and concerns.

One such movie is the movie called “Provoked” wherein a murder by a woman is justified. Another such movie is “Saat Khoon Maaf” wherein once again a criminal minded woman is projected as a victim and her blood thirst is justified by vilifying men and projecting them in bad light. These types of movies create a social atmosphere which makes it acceptable for a woman to murder a man and later claim that she did it to escape his “torture”. 

SIF alleges that when no one is bothered to raise voice against such movies which openly target the entire clan of men, why we are creating an exception for Vishwaroopam?

It’s because of such movies as above that men have been turned into “silent beasts of burden” when they are treated as FREE ATM MACHINES and UNPAID BODYGUARDS, in families and societies.Many a men who aren’t able to sustain the harassment and pressure succumb to it and commit suicide. This is directly evident from the suicide statistics published by the Ministry of Home Affairs as shown below.

We see that every year almost 80,000 men commit suicide compared to 40,000 women. So, while men aren’t double in terms of population when compared to women, but almost double the number of men do commit suicide. But because men are disposable entities, large scale suicides by men have never become a social concern let alone a social problem. And married men form the largest chunk of suicide victims as we see below,

In the year 2011, 62433 husbands committed suicides compared to 32582 wives. A cursory glance at the previous years, establishes the trend.

The Honorable Supreme Court of India had termed misuse of Section 498A (Dowry Law) as “Legal Terrorism” as it was a clear case of state sponsored extortion of innocent men and their families. 

SIF feels the way Kamal Hassan in being treated; this is yet another form of legal terrorism wherein the Govt. has failed to action against violent protests. If the protestors had so much of an issue against the movie they could have either filed a case against the CBFC for allowing the movie to be screened or they could have simply refrained from watching the movie i.e. boycotting the movie and announcing the same using media.

Men’s rights activists had demonstrated a very peaceful style of protest against the latest Aamir Khan starrer “Talaash” which they boycotted from watching and announced the same in media. The boycott call received widespread media attention, yet there was no violence and the protest was registered and message was conveyed.

SIF also feels that the Indian Judiciary is equally at wrongs by admitting every controversial case when it claims that it is overburdened. If, the judiciary is really overburdened, there must be a strong mechanism to filter cases and not listen to every case. So, it clearly means that either judiciary is not overburdened or it likes it to be that way. Both the situations are extremely grim as it harms the ordinary litigants who have to spend years and decades in courts to get justice.

Today, Kamal Hassan is talking about leaving the country, tomorrow; many such men will leave the country as legal terrorism goes on unabated in this country where democracy and free speech are emblems of mockery.

SIF would like to conclude the press release with a final set of demands as follows:


1.      Gender neutral laws to be made.

2.      The Govt. and law makers must ensure that legal terrorism is stopped in this country so that innocent people are not harassed.
3.      National Commission for Men is formed.
4.      Men Welfare Ministry is formed.
5.      Adequate steps are taken to safeguard people from false, frivolous and vexatious litigation with the following lines being enshrined in the laws,
Notwithstanding anything contained in thelaws, whosoever makes any false and frivolous or vexatious complaint shall, on conviction, be punished with imprisonment for a term which shall not be less than two years but which may extend to five years and with fine which shall not be less than twenty-five thousand rupees but which may extend to two lakh rupees.

SFF PRESS RELEASE: International Men’s Day(IMD), 19th November



Subject: The theme for this year’s IMD is: “Stop Abuse Against Men”



International Men’s Day is first celebrated in Trinidad and Tobago in 1999. Since then, every year it is celebrated in more than 80 countries across the world. 


Today, the social expectations from men are continuously increasing. The suicide rates of married men are going skywards as more and more men are taken for granted for their contributions to family, cultures and societies. Every year, International Men’s Day is observed to celebrate being male and to spend one day acknowledging the positive contribution of men towards family and the society, in this age of constant criticism, male bashing and misandry in popular culture.

This year, the focus of International Men’s Day in India is to initiate the discussion among men about the very attributes and constraints of “being a REAL MALE”. Till now, most men perceive it to be unmanly, if they discuss any of men’s weaknesses and vulnerabilities including celebrating International Men’s Day. These attitudes are not helping men transform for a peaceful world.

In past, many powerful patriarchal men even considered it unmanly to celebrate the international Men’s Day.
When 3 times more men compared women die in accidents, murders and suicides every year in India, still many men live in denial of their own problems and refuse to seek help or support as they are stuck inside the traditional notions of manhood. Freedom of men from these regressive attitudes is a must, if we all wish for a better world for every human being. Its time men start communicating and sharing their issues and their personal vulnerabilities in their relationships.

According to our survey, 84% of urban Indian males find domestic violence against men by women is funny and abused husbands are not male enough.

Such mindset basically means Men who hit back at the abusive women are “Real Men” and Men who take the abuse without reacting, are not “Real Men”.

Interestingly, the feminists want men to change and yet they want men to remain “Real Men”. Such contradictions in their thinking show, how intellectually challenged they are.




If men have to transform, then one has to look at Male Identity from Men’s Prism, not from Women’s Prism or from Women’s Studies Courses or feminism.
Men must not be made to Earn Manhood:

Do we ever make any woman earn her womanhood? How ridiculous it would be, if we start doing that. Do we call a girl a woman, when she produces a child? No. A girl becomes a woman due to biology. However, societies and cultures have always made men earn their manhood by taking risks and achieving some definite accomplishments. So often we hear the phrase, “be a man and do something”. Men who fail in taking risks or showing courage or Men, who do not have accomplishments are shamed as “losers” and “cowards”, who are not male enough. Cultures have kept the male identity very delicate.

The male ego is fragile, because cultures have made manhood of a man very delicate.

Such attitudes constantly create pressure and stress on men to perform, otherwise he risks losing his identity as a male. So, men avoid doing anything that makes them laughing matter for others, including not sharing their problems and weaknesses. The other side of this behavior is men try to show off their manhood and brag about their achievements and sexual exploits. 

A Man is a man, irrespective of whether he is straight or gay, rich or poor, employed or unemployed. A Man must not be culturally made to earn his manhood.
Women and Men must stop shaming men, “What kind of Man you are? Common, Be a Man”.

On International Men’s Day, 19th November, we urge:

1.      Men in powerful positions must stop living in denial about men’s issues and even their own vulnerabilities.
2.      Male film actors must work to end the glorification of violent male protector role.
3.      Men must not be shamed with expectations of traditional male identity. Its time society stops tearing men between both traditional Conservative and modern Liberal expectations.
4.      Immediate establishment of Male Studies departments in Universities.
5.      Men must go beyond “Good versus Evil” wars so that we can have a peaceful world.
6.      Establishment of National Commission for Men to create gender equality.

Every day is not a Men’s Day. Otherwise, the world would not have seen slavery and discrimination of Men on the basis of race, caste, color or religion.

Its time Men stop living in denial about their issues and celebrate International Men’s Day (IMD).



Survey about Men’s Attitudes and Men’s Issues:



This survey was conducted in 3 urban Indian cities and it is about Men attitudes towards men’s issues and gender relationships.

1.      Most men find videos of wife beating husband as funny. 84% men say domestic violence against men is funny.

2.      85% urban men are not aware of laws related to marriage like Hindu Marriage Act and other laws.

3.      One in 12 married men between ages 25 to 40 is separated or is facing divorce.

4.      Only 4% of all unmarried Men recognize Marital Problems may impact their lives in future.

5.      87% men are more worried about safety of their parents than themselves, when their marital problems escalate. They hate to imagine, their parents going to courts.

6.      67% (2 out of 3) men find it difficult to share their relationship problems to their parents or close friends until it is too late. They are scared that parents and friends will not trust them.

7.      Most men are also over protective about their sister’s or daughter’s marriage. 92% of men of all age groups find it very difficult to accept the breakdown of their sister’s or daughter’s marriage.

8.      50% men going through marital problems feel low self-esteem, feel depressed and contemplate suicide at one time or other.

9.      52% men find it difficult to indulge in sexual intercourse, if verbally abused by wife or partner the same day. They tend to reject any advances made (by wife).

In 2009, 2008 and 2007 the dowry death convictions are 1882, 1948 and 1946 respectively.

Our Demands:

1)     The time has come to establish “Ministry for Men Welfare”. We demand on this day to the Govt of India to establish the “Ministry for Men Welfare”

2)     All gender biased laws like IPC 498A, DV Act, Proposed Sexual Harassment at Workplace Bill”, Proposed “Marriage Law Bill 2010 (Amendment)”, Adultery Law (IPC 497) should be made Gender Neutral.

3)     End the "legal terrorism" perpetrated through the misuse of anti-male, anti-family laws. Make IPC 498A bailable and non-congnizable.

4)     Make provisions to punish those who abuse the judicial process irrespective of gender.

5)     Confer protection upon men against verbal, emotional, economic, physical and sexual         abuse at home and in the work place.

6)     Grant joint child custody to both spouses upon dissolution of marriage.
