Man freed in rape case, court says it was extra-marital affair

Court said married woman, who had four children, got involved in affair during subsistence of her marriage.

A man accused of raping a married woman on the false promise of marriage has been acquitted by a Delhi court, which observed it was a case of an "extra-marital affair being converted into rape".

The court said the married woman, who had four children, got involved in the affair during subsistence of her marriage and to save herself from "embarrassment", filed a false case against her paramour when her husband came to know about their relation.

"This trend of extra-marital affairs being converted into rape cases is coming up as several such cases have been filed in court on similar allegations. When a woman herself is not in a capacity to marry another man during the subsistence of her marriage, then why should her paramour be prosecuted, incarcerated and be tried for rape when it is actually just an extra-marital affair.

"This kind of unscrupulous litigation is required to be nipped in the bud itself," Additional Sessions Judge Nivedita Anil Sharma said, adding with changing times, the understanding of "morality" is also changing.

The court acquitted Moti Nagar resident Samir of the charges of rape and cheating, saying there is no material on record that the 25-year-old woman was forced into physical relations by the accused on a false promise of marriage.

"In fact what emerges from the evidence of prosecutrix is that there appears to be an element of an extra-marital affair between her and the accused which came within the knowledge of her husband due to which she left or was made to leave her matrimonial home and consequently the rape case was lodged (against accused) probably to save embarrassment for herself and maintain relations with her husband," the court said.

According to the prosecution, the woman filed a complaint with the police alleging that from January to April 20, this year, Samir repeatedly raped her on the false promise that he would marry her.

Crime against men today increasing a rapid speed , but who cares for that?

If we found a cases like this related to a Married men , forget about court order even a allegations like this , not only the Husband , along with him his age old mother/unmarried sisters also had been put behind the bar under 498A , Dowry act , forced to provide a home to wife under DV act, hefty maintenance under CRPC125 and then keep making round the courts next 15 to 20 years to prove that the allegation is false and fabricated.

Sub: Save Family Foundation (SFF) calls for Peaceful Candle March in the honor yet another Martyr of Marriage

Morning Shocker:

It was a usual Wednesday morning to which Bangalore woke up, only to be shaken by the brazen news of a young man of 36 committing suicide due to alleged torture by wife leaving behind his 1 year old son, 2 married brothers, an old mother and an unfortunate suicide note blaming his wife and mother-in-law for the extreme step of ending his life. Techie by Profession, Manoj Kumar worked for Oracle, while his wife Pramila worked for Bharat Electric Limited.

Manoj has had a tumultuous marriage. Constant torture by his wife which reached unbearable limits as she forced him to stay away from his family under threats of getting him jailed under a false 498A (dowry) case led Manoj to write “Sorry Son” on his T-Shirt before hanging his body from the ceiling fan on the unfortunate night of 8^th April 2013. This was after his wife abused his entire family, physically assaulted his brother with a helmet and tried to attack his old mother before she dared them that she would get them jailed in false dowry case if her demands are not met.

Manoj is not a solo victim but amongst lakhs of men who are abused daily in marriages and with this suicide, he enters the thousands of unfortunate men who die a silent death in an insensitive society that refuses to protect men.

Far Away in Dehradoon:

Manoj’s case is not very different from the case of Dr. Prashant Pandey of Dehradoon who committed suicide about two months ago as he was trapped in false cases and was not getting justice anywhere from the legal system. 55 days after he succumbed to the anti-male bias, his perpetrators roam free in the society while the Dehradoon DCP gives lip-service to his family.

Save Family Foundation (Regd.) comprises of families fighting against all laws that aggravate marital disputes; promote abuse of the elderly; violate basic human rights of men, women and children; precipitate family break-ups, facilitate the acquittal of the misuse of the law and promote a fatherless society. 

SFF recognizes such abuse of men is growing by the second and being exasperated, these men are committing suicides. These men are not dying; they are actually “Martyrs of Marriage”, as they lay down their lives at the altar of marriage trying to protect it from their vindictive, abusive, manipulative and greedy wives.

Having no law at their disposal to protect them and also fearing false cases being lodged against them under the various anti-male laws, these innocent abused male victims feel it’s the end of the road and take to the extreme step of ending their lives. SFF displays solidarity with the families of such victims and strongly condemns their deaths.

No Isolated Cases:

As per data provided by the National Crime Record Bureau (NCRB), every year more than 62000 married men are committing suicides and the number is rising. In the last 15 years close to 200,000 married men have committed suicide directly due to domestic violence and torture from wife as per the analysis of NCRB, a unit of Union Home Ministry.

A mark of respect for the Martyrs of Marriage:

On the Saturday, 13^th April, 2013, four cities – Bangalore, Delhi, Lucknow and Kolkata – will rise for men as citizens will be participating in Peaceful Candle March praying for the departed souls of the Martyrs of Marriage demanding strict action against such women and their family members who abet the suicides of these martyrs.

The Address for Delhi Protest is in front of Delhi Police Headquarters (ITO).

Time: 6:00 – 7:30 PM, Date: 13 April 2013

SFF Demands:

1.       CrPC 41 Amendment should be strictly followed. Registration of FIR should be carefully done and Power of Arrest should be carefully exercised.

2.       Fair and Unbiased investigation of cases. Complainant’s claims should be diligently investigated and verified.

3.       Police should be sensitized towards issues of domestic violence faced by men. Proper Complaint redressal mechanism for Husbands harassed by the wife.

4.       The cases related to Suicide of Husband should be dealt with same sincerity as it is dealt with Wife’s Suicide.

5.       Suicide of Married Men is a serious issue (double the rate than married women) and the unfortunate incident of suicide of Sh. Manoj Kumar should be reminder to the system to improve its sensitivity towards Married Men suffering from domestic violence and threats of false cases by the wife.

After divorce you are free to do what you can and you are not doing any household work for husbands or husbands family , so why make husband responsible for your not able to earn the money? If a husband make same claim, will they agree to pay the Husbands a working wife monthly maintenance?

Now will they give the expenses a husband does to his wife like and have ever made any study how much cost it is need to meet those expenses, like

1. Staying in Good Flat/home with all furnished Households.

2. Food, Traveling, Shopping

3. Personnel care, cloths

4. Medical and Health care

5. Gold Jewelries, diamonds, ornamentals

6. Purchase of Property/Flats.

7. Miscellanies EXPENSES IN THE NAME OF FESTIVAL, VISIT TO PARENTS/BTOERHS/SISTERS.

WHO PAYS ALL THOSE EXPENSES? DOES WCD PAY THOSE EXPENSES FOR ALL HOUSEWIVES?

If husbands start calculating the same, he will have much better option. The proposal of WCD is not only sick is totally shows their typical male haters attitude. Instead of encouraging women to be self depended, they are teaching them how to enjoy a lavish life style without doing any hard work.

Teach your women to first get established before getting marriage, if she had so much problem, no one put a gun in her head to get married and became a Housewives or working wives, it is their own choice to live a comfortable lavish lifestyle by their own, no one put a gun to them before marriage, so the decision they have to take before marriage than cry after wards and make the whole marriage relationship based on money, money, money!!!!!

"But the Ministry of Women and Child Development is definitely wrong with its proposal to make it mandatory for men to share a percentage
of their salaries with their wives who are homemakers, presumably to make up for their work being unpaid. Leaving aside the philosophical
objection that it would be paternalistic and illiberal, at a more fundamental level this proposal completely misunderstands the
economics of unpaid work.

If it was possible to correctly measure, unpaid work would increase the notional value of a household’s income as it would add the
non-market “income” of the housewife to the earned income of the husband. But making men pay their wives for household work doesn’t
increase the household’s total income and amounts instead to a forced transfer payment from husband to wife – like a tax within the
household imposed by the government."

There’s a legitimate debate over unpaid work and measuring its value would be important considering how widespread it is in India. But
proposing that husbands should be taxed to subsidize their wives is an all together different issue. A more direct solution to the problem of
unpaid work is for the government to directly subsidize the housewife. The downside to this is that it would create yet another costly
entitlement program to add to the many that the government has already created.
