Law commission Report clearly suggested to make #RapeLaw by replacing the word Men/Women to person .

Lawmakers totally ignored the same due to pressure from WCD NCW and Women organisations of India !

Result all the Rapist Women are moving freely in our Society. They have no fear of law , first they rape men/boys and if the Men/boys #SpeakUp , such Rapist Women are terming the men/boys are rapist to hide their own Crime.

Stop to be a #Mangina and stop protecting criminal #RapistWomen of India ! Time to make #IPC375 gender neutral by replacing the word Men/Women to person .

Movie - Miss Tanakpur Haazir Ho : #CryRape & term Man #Rapist.




Miss Tanakpur Haazir Ho, based on a true Story of fact of Indian Rape law and now Media, Police, Politicians, Judiciary and we common men reacts.


The foundation of the Movie, about a fake allegation of rape that is foisted on a hapless young man, beggars belief. But this is Incredible India, where fact trumps fiction every single day and the media throws up levels of bizarreness that are beyond the imagination of the average screenwriter.


The pradhan and his cohorts Bhima (Ravi Kishen) and a charlatan priest (Sanjay Mishra) dream up with the preposterous idea of framing Arjun for the alleged rape of the pradhan’s prized female buffalo, which is fresh from winning a recent bovine fashion show and hence known as Miss Tanakpur. Om Puri’s greasy-palmed police officer is happy to let the farce make its way into the courtroom, and even the judge plays along instead of consigning the case into the rubbish bin.

From the Child Hood I always wondered, why our Censer board of Movie asks the Directors to remove Love making seen as absence, but rape seen as need of the Film. The number of rape seen I have seen even in old 70’s movie outnumbered any good love making seen.

Thanks to our Misandry – Male hatred, from the History we used the word “rape” as heinous crime, having most strong Punishment Clauses and keep crying to make it more strong and keep amending the same to such a extent, that today to file a Rape cases, there is no need of any medical evidence, there is no need of time limit.

Mere verbal allegations of Rape and the man are behind the bar.  Time to time we have witness many Judgments from court, but we never agree to the need of making any correction to reduce #Fakecases.
We all used to believe all cases of rape like we used to see in Movie uncensored way only happen. Common men or a woman does not know:

The most important fact , a person after gone to Jail and after long trial like 7 or 10 years : 'Honourably acquitted, but honour can never be restored'



Anil, a property dealer from West Delhi, was last week honorably acquitted by a Delhi court in a rape case lodged by his sister-in-law following a long-pending monetary dispute. 

Even as the court acquitted him honorably, Anil says his “honor can never be restored”. “My life and my face in the society can never be the same. Only I know how I am alive. Accusation of rape is a punishment in itself, even if false,” he says.

This and many similar cases show a vast shift from the times when it was a common ground that no women would make false allegation of rape given the social stigma attached to it. 


I had able to meet many film makers, asked them several time, they are very active to rise many social issue by their movie, but why they shy to rise a so genuine issue of unfairness of Rape law?

 


Maximum time we get reply, it’s a women issue, and we can’t do that as a male feminist or female. 


 

Show them so many mails and call details, it is not only men issue. We get more than 70% call form women only in the form of Mother, sister, daughter, wives  for help as some one’s brother or father or husband or friend had been accused as rapist under the unfair clause of rape law. 

 


It’s not that only women abuse the rape law, for every fake cases filed by women, at least 2 or 3 men who are victim of Misandric Virus ( male hatred) Mindset cheers behind the seen.


 

But all goes in deaf ears as usual. But when I saw the trailer and heard about the movie called: Miss Tanakpur | Official Trailer | Annu Kapoor | Rahul Bagga ... it was known to me, their release will not be as smooth as they might have expected.

 


When a person is accused to rape to a Buffolo can go through all such trauma and suffering, one can understand when women #CryRape, what extend a man has to suffer.


 

The law is framed in such a way, neither Police or court can put in dustbin any fake rape cases, let he accused by Buffolo also.

 

Many country came out with progressive Legislation along with strong good will by Judiciary for strong punishment for fake cases, Rape test Kit to determine the same as positive or negative.

 

Many country made rape law gender neutral (if women don’t do rape why they should afraid), as UN-consented sex not only men, women also capable to do.

 

Yes, none can stop the Fake cases of rape nor any strong law will able to eliminate the crime called rape from society, but need the balance, sending some one behind bar mere verbal allegations is not Justice, it promotes injustice.

 


History witness, when somewhere Injustice happened, threat of Justice occurred everywhere.


 

I wish a grand success of movie Miss Tanakpur, which expose not only short coming of our unfair, biased assumption based rape law, it expose how our Police and Judiciary put fuel in fire in such cases.

 

Will be waiting when directors like Madhur Bhandakr will wake up and come out with some more true story of fake rape cases.

66A Scraped what about 498A , 354 and 376 ?

On the eve of SC #Scrap66A , we all welcome the decision and establish that a badly drafted law can only lead to havoc in Society.


There are many such laws like 498A , Molestation ( 354) , Rape(376) also fall in that category .


The Indian constitutions article 15(3) had been misused just for Vote bank in the name of Women or caste , the way in 66A the constitutions 19(2) was misused, but in reality there is no improvement in society for what such provision was made.


As per New Law if a women can term any Men as Molester or rapist without any medical evidence. 

 

Mere on her Verbal allegations, you will be arrested and even after court trail found the same was #Fakecases hardly any Police officer or Judge will evoke CRPC340 or IPC 182.

 

Our Law Makers and women organizations along with some radical Feminist  Ideology Electronic Media always promoted such decoration Law as Non-Bailable , lead to massive Misuse and violation of Constitution article 21-( Live & Liberty) .

 

Now , when SC will wake up and take corrective action against such LAW which had been made under misuse of article 15(3) by violating article 21?

 






Indiatimes has in its possession the formal judgment (dated 28 February 2015) pronounced in the 2012 ‘Amity rape’ incident. The incident dates back to 2012, when a girl had accused two boys of gang-raping her. 3 years later, the incident received a conclusion – the boys were free to go. During this time, the boys served 1 year in prison, and 2 years of regular criminal proceedings.

After 3 years of being labeled criminals by society, friends and family, Prashant and Milind, 2 Amity University boys have been acquitted by a trial court of allegations of raping a fellow student. The court pulled up Delhi Police and the investigating officer (IO) for carrying out a biased probe, cooking up evidence and hiding crucial information in the case which proved the innocence of the accused.


According to the police, the alleged incident took place on the afternoon of June 14, 2012. Prashant called the woman, who was his batch-mate, to Vasant Vihar to watch a movie. He was accused of giving her an alcoholic drink, driving her to a secluded place in Paschim Vihar in his Honda City car, calling his friend Milind to the spot and gang-raping her.

At face value, you can see that the testimony the girl gave was pretty damning – there was the dramatic allegation – intoxication and violently forcing a girl to submit to rape.

And just her statement was enough. Just her testimony led to investigating officers framing charges on the two boys. She also claimed that she had been treated so badly that she "had developed suicidal tendencies". Her statements were treated with even more delicacy particularly in the wake of gruesome attacks on women in the last 3 years after the infamous Nirbhaya incident. 

And then her testimony fell apart.


There was no DNA evidence.


The girl was admitted at New Delhi's AIIMS Hospital for 14 days after the rape, during which NO vaginal examination was conducted. She also said that the boys who gang-raped her had washed her clean to get rid of evidence. However, there was no residual DNA on her clothes. She also made accusations of “unnatural sex” – but evidence didn’t prove it. 

And what about the scene of the crime?


Police didn't actually investigate the scene of the crime, the place where she claimed she was raped. 

And the violence against her?


If they had explored the place, they MIGHT have found traces of her blood that spilled when she cut her leg there. When there were no cut marks on her body, she claimed that she was beaten with an ice bag. 

Which was also false - as Advocate Prashant Mendiretta, counsel for the accused, informed us. How can this ice not have melted in 42 degree temperature, in a room that had no fridge, air conditioning or even a fan? These were the conditions she described of the room she was supposedly raped in.

Psychological trauma?  


The court also rejected the prosecution's claim that the woman was so traumatised that she initially did not report the rape but only spoke about assault. Relying on hospital records and other evidence, the court said the woman was in her senses when she was examined on June 15, 2012, a day after the alleged incident. The court also observed that it appeared that the woman, after the incident, faked psychiatric disorders and was therefore referred a senior psychiatrist at AIIMS. The woman spoke about being gang-raped by the duo only on June 28, 2012, 14 days after the incident.

The evidence that sealed her fate and saved the boys,

Cellphone records obtained show that during the time when she was allegedly being assaulted and raped, there were multiple calls made to her phone.

She spoke 1000 seconds: with her friend
She spoke 300 seconds: with her father
She spoke 400 seconds: with her mother

This is among 50-60 calls she made/received from her number. 

And yet, not once did anyone raise alarm. 

The cellphone tower position logs indicated movement of the cellphone. How can someone get raped, and have someone make/receive 50-60 calls from their phone?


The judge urged the police chief to frame guidelines making it mandatory for IOs to bring to the notice of the accused all evidence in a case, including those that favour the accused.  "She (the IO) has betrayed the trust reposed by the public upon a police official. The aim of the police officer should be to collect evidence and not to create it...(She) committed breach of professional standards by ignoring, disregarding and withholding material evidence which pointed to the innocence of the accused," the court noted while delivering the verdict.

Trivial Disputes: Women are filing Molestation cases and misusing #IPC354


Many young guys supported strong #IPC354 without prior understanding of the law, which led to #IPC354 be made non-bailable. As per this law any woman can label a boy as ‘Molester’ without having to undergo a medical examination.

Recently in SIF we are getting many complaints that even age old ladies are filling molestation cases against young boys secondary to trivial disputes such as Parking of cars or bikes.

25 years old Arun, working in Delhi metro one day reached home on his bike and found that their neighbor had parked their bike in his place. He requested the neighbor to move their bike to an alternate place, but they refused and started to abuse him. He contacted Delhi Police at number 100 after which the neighbor removed their bike.

But a big surprise awaited him the next day morning. He received a call from local Police station, that he and his 22 year old brother were accused of Molesting the neighbor who was a 45 year old woman.

Police arrested them both and put them behind bars for 9 days, which is the time it took for them to get bail. All his lawyers and other neighbors asked him to compromise and offer 5 Lakh Rupees to the 45 year old woman. He was left very confused, and wondered why was he put through such injustice? He started calling us to seek answers for why such unfair, biased law was made in the first place?

Mr. Arun is not alone, every day in SIF we witness such cases and find that young guys are totally ignorant and unaware of the dangers of #IPC354. This law was created in a way, that any women irrespective of her age can send any man behind bars by a simple verbal allegation.

In the parliament many MPs did express concern about its misuse, but radical feminists ignored their valid concerns. SIF also made recommendations to ensure innocents were not harassed, however government paid no heed to what MPs and SIF were stating and went ahead in approving this unfair, and biased law.

In another case in a shopping mall, Mr. Karan Gupta, 35 years old, met with an accident. A young woman crashed his car from behind. He immediately started video the situation using his mobile phone.

Although the woman was at fault, she started to be abusive towards him. In order to seek justice Mr Gupta contacted Police at 100. Police officer took both of them to the local Police Station.

At the Police Station the woman filed a molestation case on him misusing #IPC354. She alleged that he had touched her private parts. Mr Gupta requested the Investigating Officer to record the lying woman’s statement and for her to undergo medical examination. The woman refused to undergo a medical exam. A lady police officer then advised this erring woman that she should not say that Mr Gupta touched her but she should make allegation that he abused her verbally and attempted to touch her body. This made the women change her statement, and IO was about to arrest Mr. Gupta.

Mr Gupta then showed IO the recorded video of what had actually happened. Mr Gupta was lucky that he was facing an honest IO. Looking at the video evidence right in front of him, he closed the case against Mr Gupta. Not only that he went ahead and filed a case against the erring woman under #IPC182 for giving false statement to a government officer with intention to hurt.

Ironically the court gave bail to that woman straightaway despite the Video evidence to support #IPC182.

This is the main reason for increase in false, fabricated Molestation and rape cases in India.

A mere allegation by a 45 years old women, without any evidence, sent two young men behind bars for 9 days. On the other hand, despite video evidence of false molestation charges, a woman got bail in 2 minutes.

Such injustice against boys or men is not new. Law makers are in deep slumber while radical feminist organizations are manipulating the Media. This leads to Media showing only incidents of alleged rape/molestation cases, but they never show any cases in which a man has proved himself innocent after having lost 5 to 7 years running around in courts.

Is there any way out?

Yes, it needs awareness and will power of our Law makers to stop such abuse of  law. They must realize that non-bailable criminal case is not a joke like ordering some Pizza. Such false allegations destroy an innocent, law abiding man’s self-esteem, confidence and faith in humanity.

Any FIR/complaint on the basis of Verbal statement of women which leads to #IPC354 must be made bailable.

The punishment for making false fabricated statement under #IPC182 should be non-bailable and strong punishment in jail terms, without accepting any excuses is the need of the hour. Government must issue strong directions in law itself, so that Judges should not allow bail in such cases where by documentary evidence (like video recording, CCTV footage, Mobile locations, and audio recordings) itself prove the case was false and fabricated.

History has taught us that sending innocents behind bars doesn’t reduce crime rates. It will only have a backlash which will lead to revenge, violence and raised crime in India.

Men as victims of Marital Rape




Rape is Rape. It is not a gender issue. When a woman rapes (sex without mutual consent) our Indian society colors the act with terms like loving or affectionate. Sadly some women consider such acts as their birth right over men. If a man tries to fight back or resist or even dreams of speaking the truth, he himself is labelled as rapist instead of being considered a Victim of rape.
 
Rape is rape, regardless of the relationship between the rapist and the victim. It can be a total stranger; someone you recognize by sight, but have never really communicated with; someone you know superficially, a neighbor or a colleague; a friend, a Girl-friend or a former Girlfriend; a live-in partner, or a former partner; someone you are married to or have been married to in the past.
 
As per Rape law, any sex without mutual consent should be considered as “Rape”. However the blinded Indian LAW assumes that the Victim of Rape can only be a woman and men are never “Raped”.
 
Rape is a very personal and intimate traumatic experience. Our experiences of and reactions to rape may differ widely. Although there are many similarities in the way that we feel about being the victim of rape, regardless of the relationship between us and the rapist, there are differences between stranger and intimate rape. In this section we are trying to describe and offer an understanding of some of the specific problems regarding marital rape (or rape by an intimate) as opposed to stranger rape.
 
Please note that in this page we refer to wives and husbands, however, it can be understood to refer to all rapes perpetrated by an intimately related person. Also, we are only looking at rape and sexual assault on men, since this is by far the most common situation but never recognized by Government or LAW makers. The result of such heinous crimes is that every year, we witness twice as many Husbands committing suicide than wives. This statistic is clear from the National Crime Records Bureau report (2005). Rape and sexual abuse also occur with similar frequency in same-sex relationships.

Historically, all cultures have had a concept of a spouses' conjugal right  to sexual intercourse with each other to curb illegitimate children and also to start apart from being an animal. The proposition of Christian teachings which influence Western culture need be considered; in particular, St. Paul's teaching: "For the wife does not have authority over her own body, but the husband does; likewise the husband does not have authority over his own body, but the wife does. Do not deprive one another except perhaps by agreement for a set time, to devote yourselves to prayer". Such teachings led to the institution of marriage.

However with time, women raised their voice, created new laws to shut men up and gained a wholesale free license to rape husbands. We have often heard Feminist, male hating ministers openly telling media “It is the turn to suffer the men”, “Do not trust men, trust condom”.. but still Indian men prefer to keep silence than object to such comments openly.

·        Different types of rape

Marital rape is generally sub-divided into three categories: those rapes, which involve a degree of violence, those that use enough force to control the victim, known as 'force-only' rapes, and sadistic rapes.
·         Violent rape occurs, as the name suggests, when the abuser uses enough physical violence to cause injury to the victim (biting, digging nails in, damaging private parts). Examples would include the wife punching his Husband or injuring him with her nails or teeth, as he is too tired after hard work in office and wants some rest when he comes home rather than satisfy his wives sexual lust. Such rapes either become part of a violent assault, or the violence becomes part of marital rape on husband. Many rapist wives will also force their Husbands to submit to sexual acts after a physical assault, either to prove her power to him or to further intimidate and humiliate him. Commonly in such instances if the Husband should refuse such an act, the threat of further violence (or another assault on him!) will soon lead him into compliance.
·         'Force-only' rape is usually termed when a wife uses just enough force to control or hold her husband in specific position, eg holding him down by his arms or wrists to prevent him defending himself or escaping. This form of rape is common where there is a larger contrast between the age difference and strength of abuser and victim, or in abusive relationships where physical violence is infrequent or non-existent (insofar as one does not categories sexual assault itself as a violent act). In most cases of 'force-only' rape, coercion plays a large part. The victim may also be so confused and numbed by constant emotional abuse, that he simply does not know how to act or react when sex is forced on him.
·         Sadistic rape is gradually increasing in frequency. In such rapes, in addition to the rape itself, the victim is either forced to comply with or undergo deeds designed to further humiliate him. Examples of this would be the abuser/rapist forces the husband to watch a pornographic movie, making threats of seeking sexual pleasure from her ex or new-boyfriend if he does not comply. She would often demean the husband as ‘good for nothing’ in bed, while acting out a fantasy of torturer, or using repeated sex in spite of repeated requests by husband to get some rest or sleep since he has to go to work the next day. Sadistic rape may or may not involve further violence. Some people consider buggery as a sadistic form of rape, since its effect on victim is often particularly humiliating.
It is difficult to clearly separate one form of rape from another, since rape can involve a combination of above mentioned types. For instance, the rapist may use coercion tactics and enough force to control the victim initially, but then will use increased violence if the victim struggles. Many victims of marital rape feel guilty for not having struggled more, or have been told that if they did not try to physically fight their abuser and thereby sustained injuries, they have not suffered 'real rape'. This can be extremely distressing and adds to the emotional, psychological, physical and moral trauma already experienced. What has to be remembered is that when you are living with your abuser, you are often very finely tuned to her, employing numerous coping mechanisms to limit the damage to yourself. You may realize either consciously or subconsciously that if you struggle, she is likely to get violent or take her anger out on you in other ways or abuse your child, ill treat your parents or relatives, make false police complaints of Domestic Violence and make attempts to abuse you financially etc.
 
Other reasons why men do not fight back are fear of disturbing children in the household, lest they should witness their father being raped; a sense of shock or confusion at what is happening which paralyses him; and real concern for his abuser, which results in him not wanting to do anything which may harm or injure his rapist even to the determent of himself. But by far the most common and compelling reason is the fear that if he tries to fight back, everyone including the law and society will term him as “Rapist” rather than acknowledging him as a Victim of “Rape”.
 
It appears that as per Rape LAW and Domestic Violence Act, all Indian women are born in Raja Harish Chandra’s family i.e. they never lie. Whereas all laws and our society believe all men to be rapists and born in Rapist families. Even a Supreme Court Judgment says, a women’s verbal statement is sufficient to term any Tom, Dick and Harry as Rapist. This is possible even if she doesn’t undergo a medical examination to examine whether a rape has even happened or not.

The Unanswered Questions:

Does Rape/Sexual harassment happen at Workplace or Home? Why do we think only women can face sexual assault? Do Men Never face "Sexual Harassment at Workplace or home" as per the wording/action as per proposed Act by WCD?


It is another truth that even: 

"The Law Commission in one of its Report dated March, 2000 had  recommended that laws relating to rape (Sec 375 IPC) be made gender  neutral.


 
It had deliberated about widening the scope of offence under Section 375 & Section 376 IPC, and for these to be made more comprehensive to bring it in tune with current times.

But the recommendation was not accepted.  Why?

  
 
Sex or comment of sex, without mutual consent is termed as rape/sexual harassment as per LAW, then why it considered that men do not face the these situations?"


 
Will our Lawmaker ever take the moral responsibility and courage to replace the words “Men/women” by the word “Person” and replace words “husband/wife” by the word “Spouse”?

Or

Do we continue to suffer and support the ideology/wisdom and action planning of radical Feminist groups It is the turn to suffer of men ”.
