Main objection to the Proposed “Marriage Laws (Amended) Bill,2010,

Main objection to the Proposed “Marriage Laws (Amended) Bill,2010,

We had already submitted our objection and suggestions to parliament committee, but the present law minister totally ignore the same and even tamper the original bill even worse by making new amended, so we request either make the law gender neutral and respect natural justice or roll back the same immediately as this will became a “extraction law” than giving any natural justice to people.

A. The Bill must be gender neutral, if a wife have contribution to husbands property( movable or immovable) , any property made by wife ( movable or immovable) also have husbands contribution, so only Even in USA-Txas law the word used "Spouse" instead of wife or husband, other wise one sided law will create a disharmony, increase of crime, huge litigation in court for property disputes.

B. The benefit of divorce can't be equal to married relationship , as the obligation and responsibility after divorce change to either spouse. Even in 2010 china SC also amended the property division law to belongs to the spouse who made it , as such law made havoc in court cases and people started use the marriage as property earning business than love or care to each others.

C. Proposed Amendment: 13D (1) Where the wife is the respondent to a petition for the dissolution of marriage by a decree of divorce under section 13C, she may oppose the grant of decree on ground that the dissolution of the marriage will result in grave financial hardship to her and that in all circumstances be wrong to dissolve the marriage…..

Our View:

Right to oppose should be given to both parties The word wife to be replaced by the word "spouse".
The line to be added: The Divorce degree will be awarded only when all other cases against each others had been quashed or withdrawn and in future no cases will be filed against each other spouse. Otherwise the basic purpose of this law to reduce the litigation will be defeated.
Like :
There are other provisions of maintenance HMA 24/25, CrPC 125, DV Act, adding another provision is duplication and a tool to harass the husband
Rampant misuse of this section to harass the husbands
As per 13C(2), if she is separated for 3 years, she would have already approached the court in case of financial difficulties.
Another attempt to extort husbands (as in 498a and DV Act).

Our Proposed: “The respondent to a petition for the dissolution of marriage by a decree of divorce under section 13C, may oppose the grant of a decree on the ground that the dissolution of the marriage will result in grave financial hardship to them and that it would in all the circumstances be wrong to dissolve the marriage. All cases pending, between the parties would also be quashed before granting divorce under Section 13C”..All case like 498A, DV Act and other litigations should be quashed before the grant of decree.”

Text of Amendments to the Bill, See item 5:

D. Proposed Amendment: 13F and 28D:( Special provisions relating to disposal of property in proceedings under 13C)

Without prejudice to any customs or usage or any other law for the time being in force, the court may, at the time of passing of the degree under section 13C on a petition made by the wife, order that the husband shall give for her and children as defined in section 13E, such compensation which shall include a share in his share of the immovable property ( other than inherited or inheritable immovable property) and such amount by way of share in movable property, if any, towards the settlement of her claim, as the court may deem just and equitable, and while determining such compensation the court shall take into account the value of inherited or inheritable property of husband.

Our View :

The word wife and husband to be replaced by spouse which followed by all over world, even in USA-Txas the same is spouse.
If this law passed as per above, for example the wife have 1000 crs ( let it be given by husband also) and husband have only 10 lacks, but as per law, her 1000 crs can't be touched, but the husband 10 lacks to be divided and given to wife? This is totally injustice and against any natural justice System of the world.

The property accrued before marriage, either spouse should not have any right, as there is no contribution of other spouse on that, the contribution to be considered only on the property made after marriage and any claim to others property to be allowed if only the marriage obligation is more than 10 years.

So Our Proposed : 13F and 28D:( Special provisions relating to disposal of property accrued during subsistence of marriage in proceedings under 13C)

"Without prejudice to any customs or usage or any other law for the time being in force, in any proceeding under section 13C, at the time of passing of the degree , the court may on a petition made by "either spouse" order that the "other spouse" shall pay for "her/his" and children as defined in section 13E, as finciancail support such gross sum or share in the movable or immovable residential property towards settlement of property rights as the court may deem it to be just and equitable, "considering the duration of marriage" and any such payment shall be secured , if necessary , by change on the immovable residential property of the other party. For any claim each others spouses residential property, the minimum marriage duration should be considered as 10 years.

E. The law should be equal and must follow the natural justice and stop making assumption that all women born in Raja Harish chandra family and all men born in criminal family.

The person seeking Divorce on "No fault Ground" , should not get the same benefit , who seek the divorce by proving other party fault. A person should not be punished for "No Fault" in the name of easy divorce nor his/her hard earned accrued property movable or immovable should be garbed under any such biased law, which will create injustice and will create more disharmony in society which in result will increase the over all crime in India.

Just like SurajPancholi, thousands of helpless men get victimized

Just like SurajPancholi, thousands of helpless men get victimized with threats of Suicide from wives and girlfriends every year.

Based on media reports and alleged suicide note of Jiah Khan, 22-year old SurajPancholi was arrested and sent to jail for committing the crime of abatement to suicide. We have to understand that such laws do not exist in other countries in the world. Is suicide a solution to break-ups or separation? Jiah Khan attempted suicide 8 months ago and nothing was done to ensure that she does not repeat it. It is absurd to assume that all human relations will remain everlasting in this age of modernity. Finally, women are portrayed as victims, and men as abusers.

SurajPancholi is no alone. Thousands of men across India call SIF helplines every week. Half of them have faced threats of suicide from their wives from time to time, if they do not meet her unreasonable demands.

These men are scared. These abusive wives refuse to come to a counselor or a psychiatrist. When these young men plead to the parents of women about their suicidal nature, parents do not take it seriously. These men cannot run away from home or file for divorce, fearing that this may prompt her to commit suicide. They suffer mental and physical abuse from possessive, controlling and suspicious wives. In fact, the society laughs at them as “Harassed Husbands” rather than helping the man and making arrangements for counseling of such women. Now, this phenomenon is getting extended to relationships before marriage as well. Being obsessively possessive and controlling is not a sign of love.

In short, India is sitting on a ticking time bomb as the society refuses to recognize the issue of threats of suicide inside marriages or in relationships. The society just behaves as if such incidents are rare or wishes that this problem will go away on its own. Then, it recommends revenge on the man if the woman commits suicide. Home Ministry (NCRB) data says, 24% of all suicides in India are due to Family Reasons and 3.4% due to failed love affairs.

Here are concerns of SIF around this case:

1.      There are no checks and balances in this abatement to suicide law. SurajPancholi did not point gun at the head of Jiah Khan to force her commit suicide. Breaking-up with a girlfriend or being commitment-phobic is not a crime. As reported, Suraj did everything he could so that Jiah Khan can get some psychiatrist help, after she attempted suicide 8 months ago. One has to wonder, why Jiah’s mother did not get her to a psychiatrist.

2.      This abetment to suicide law is very selectively applied by police. When a husband commits suicide blaming torture by wife and in-laws, the police refuse to arrest the woman and her parents. However, if a wife commits suicide, the husband and in-laws go to prison for 6 months to 2 years and are presumed guilty until proven innocent. Is the life of a man cheap? Males are the disposable gender.

3.      This abetment to suicide law and the social attitudes around it actually encourage suicides, by taking away the responsibility from a person to preserve his or her own life.

4.      Many possessive women are already abusing their husbands and boyfriends and threatening suicide, if he stands his ground and defends his dignity. Arrest of SurajPancholi will only increase such incidents rapidly. A man is completely helpless here.

5.      Jiah Khan attempted suicide 8 months back. It is reported that SurajPancholi was extremely concerned about her life after that incident and he called her mother to India and he even spoke to her for taking Jiah Khan to a psychiatrist. What more can a man do? He is helpless beyond a certain point, when a woman is obsessive and suicidal?

6.      Did Jiah Khan’s mother Rabiya Amin take her to a psychiatrist or counselor, even after knowing about her attempt to commit suicide? As a mother, is not it her responsibility to ensure that her daughter handles stress and relationship troubles with help from mental health professionals?

7.      SurajPancholi and many men are victimized as the hatred against men or misandry in general is fueled by mass hysteria after incidents of rape. SIF demands an end to large scale gender hate, stereotyping and the attitude to judge men harshly. If hate cannot solve communal or religious problems, then why it is assumed that blaming men and spreading hate against men will solve crimes against women?

8.      If a young man commits suicide and he leaves a suicide note, blaming his girlfriend for hurting him, cheating on him and abusing him, will the society show same fervor in demanding arrest of the girl involved? If not, then why men are victimized for the decision for a woman to commit suicide for break up?

Threat of suicide by man is actually defined as domestic violence under Protection of Women from Domestic Violence Act (PWDVA), which is applicable to both marriages and live-in relationships. A woman can get a restraining order from a court against husband and boyfriend if they threaten suicide. However, the society and the women’s organizations force Government to refuse to protect men from such forms of domestic violence. If they had, then SurajPancholi would have got a restraining order and would have legally forced Jiah Khan to get psychiatric help.

It’s a slap on the face of Bollywood

Finally, Bollywood itself has indulged in spreading large scale hatred against men in recent times, with anti-male stereotyping without looking at issue in a more academic and meaningful manner. Many Bollywood actors are full of misandry. Now, one among them has committed suicide and a budding actor is in prison. It’s a slap on Bollywood’s face and its shows how disconnected Bollywood is from group realities in spite of its false claims to transform the society.

Many actors like Shah Rukh Khan to Amitabh Bacchan have publicly proclaimed, “I am ashamed of being a man”. Shaming all men for the crimes of a few is nothing but anti-male hate or misandry. If misogyny is not healthy for the society, then how can misandry create a better society? We hope, Bollywood actor realize that in this grave hour.

In this particular case (below), a husband committed suicide blaming torture by wife and in-laws. The police did not arrest the wife and in-law even after hundreds of phone calls are made to Mumbai police by SIF members. If the law of abetment to suicide is to save people from suicide, should not it be applied equally to both genders? Or is men’s life cheaper in Indian society?

SFF Demands that:

1.      Government must bring checks and balances to all laws related to suicide, like abetment to suicide and dowry deaths.

2.      Government must make domestic violence law gender neutral and protect men from wives and girlfriends, who threaten suicide every now and then.

3.      Suicidal women must be forced to undergo counseling and treatment.

4.      All laws must be made gender neutral and both genders must be treated in a fair manner.

5.      The society must take steps to curb misandry. It is challenging, because it is too easy to blame and stereotype all men citing incidents of rape or other crimes against women. Such misandry will vitiate gender relations.

6.      It must be ensured that, men’s rights to liberty, dignity and basic human rights are not snatched away in the name of empowering women.

According to National Crime Records Bureau, about 20,000 men and about 12, 000 women committed suicide in 2011 for “Family Reasons” alone.

All India Forgotten Women’s Association announces boycott of International Women’s Day

About All India Forgotten Women’s Association:

All India Forgotten Women’s Association (AIFWA), a group of bereaved, beleaguered, harassed, distraught and tortured women of India, has decided to boycott observing the International Women’s Day which happens to fall on the 8th of March. AIFWA gives a face and a voice to those mothers and sisters of husbands who have been harassed by women and women-centric laws and have nowhere to go. AIFWA gives a platform to women smitten by feminism to voice their woes and seek justice for the injustice done to them.

The Problem:
A lot of false cases are making their way to the courts under Section 498A (dowry law), Domestic Violence Act, various Maintenance sections in order to harass husband and his family and encash a bad marriage. These cases are primarily targeted to harass the husband and his family in order to coax them for an out of court settlement which more often than not involves huge alimony to the tune of millions and crores.
Often the entire family of the husband including small children, pregnant sisters, old parents, are named in the FIR in order to put pressure on the husband. It is ironical that, at the pretext of one woman, on average, 3 other women suffer who are the husband’s relatives.
Do you know?
1.      Every year close to 40,000 women are arrested in false dowry cases without trial or investigation on the basis of one uninvestigated complaint as per arrest data provided by the National Crime Record Bureau, Ministry of Home Affairs.

2.      In the five years period from 2004 – 2009, close to 2,00,000 innocent women have been arrested in false dowry cases, while the British Government arrested just 20,000 women in 40 years as per arrest data provided by the National Crime Record Bureau, Ministry of Home Affairs.
3.      Domestic Violence act has forced senior citizens to leave homes built by their own hard-earned money and live on footpaths and gurudwaras due to faulty orders of right to residence being passed against husband and his family.
4.      There is no provision of remedy for a woman harassed by her daughter-in-law or sister-in-law (brother’s wife).
5.      All the women-centric laws are, in reality, wife-centric laws and they discriminate amongst women and do not provide relief to mothers and sisters of husband when the wife and her family inflict violence onto them.

6.      As per study done by National Family Health Survey, women face 8 times more violence in their natal homes, at the hands of their mothers compared to that at the hands of their mothers-in-law post marriage.

7.      Every year more than 62000 husbands commit suicide as per data provided by the Home Ministry and not a single wife has been punished so far. None of the mothers or sisters of those men have received justice for the death of their sons or brothers.

8.      Feminists do not consider mothers and sisters of husband as women?

9.      When a distressed mother-in-law approaches the National Commission for Women for help, she is turned down as the alleged perpetrator is her daughter-in-law?

1These women have no platform to voice their concerns.

Boycott of International Women’s Day and Celebration of Forgotten Women’s Day
All India Forgotten Women’s Association have decided to boycott the “International Women’s Day” which falls on March 8th and have instead decided to observe “Forgotten Women’s Day” on March 9th, a day after International Women’s Day as a mark of protest against inter-gender and intra-gender discriminatory stands taken by feminists. The stands taken by feminists are just aimed at poisoning man-woman relationships in the society in order to monetize every intra-gender relationship under the cute name of “Women Empowerment”.
As the Govt. of India currently does not recognize the rights of these women, and passes laws as per the demands of the feminist lobby or the wife-centric lobby, these women have decided to call themselves as the “All India Forgotten Women’s Association” because amidst the feminist hoopla, the society/government/media has somewhere forgotten that mothers and sisters of husband are women too and need protection from abusive wives and their vicious and greedy families.

The Event

In order to mark the protest, register the boycott of International Women’s Day and observe the Forgotten Women’s Day, AIFWA announces a Dharna followed by peaceful protest march on the 9th of March 2013 at Jantar Mantar, New Delhi (11:00 AM to 5:00 PM). Hundreds of mothers and sisters, supported by victimized husbands will be participating in the event to voice their grievances.

In spirit, they will be supported by thousands of members all over India belonging to various NGOs under the umbrella of the Save Indian Family (SIF) movement.
This event is being supported by at least 40 NGOs all over India like All India Mother-in-law Protection Forum (AIMPF), Mothers and Sisters Initiative (MASI), Mothers and Sisters of Husbands Against Abuse of Law (MASHAAL), Save Family Foundation (SFF), Save Indian Family Foundation (SIFF), Pati Pariwar Kalyan Samity (PPKS), Army Against Dowry Law Misuse (AADMI), Hridaya, SIFF Andhra Pradesh, SIFF Nagpur, Indian Family Foundation, Men’s Rights Association (MRA), Children's Rights Initiative for Shared Parenting (CRISP) to name a few.

These NGOs are spread across the country in cities like Delhi, Bangalore, Pune, Mumbai, Nagpur, Lucknow, Hyderabad, Mysore, Kanpur, Kolkata, Guwahati, Chandigarh, etc. and carry a cumulative strength of at least 50, 000 members who have been victimized by misuse of dowry laws and domestic violence laws.

Our Demands

AIFWA places the following demand on Forgotten Women’s Day before the society and Govt.

·        The National Commission for Women was set up as statutory body in January 1992 under the National Commission for Women Act, 1990 ( Act No. 20 of 1990 of Govt. of India ) to :

·         review the Constitutional and Legal safeguards for women ;
·         recommend remedial legislative measures ;
·         facilitate redressal of grievances and
·         advise the Government on all policy matters affecting women.

We want NCW/Government to define specifically what is meant by “Woman”. Is she a mother, Is she a sister, Is she a mother-in-law, Is she a sister-in-law or Is she only a Wife.

Define clearly “Woman” in your Bye Laws.

·         We demand a separate cell in NCW to look after the grievances of Mother-in-Law and Sister-in-Law.

·         Every year more than 40,000 innocent women are arrested without any investigation over last 5 years under IPC Section 498A. We demand a public apology to these women, as the Government has done nothing to address the grievances of these women.

·         Reform National Commission for Women and Women and Child Development Ministry to include mothers and sisters as women, in their definition of women.

·         There is no law to protect a Woman from her son’s in laws. We demand a separate law for the protection of such Women.
·         Stop the discrimination against mothers and sisters of husband.
·         Stop the misuse of dowry laws and domestic violence laws.
·         Take steps to reduce suicides by Our Sons/Brothers.
·         Scrap all gender biased laws and bring in gender neutral laws only.
