My Two days at Men's Conference at Mumbai on 15th August

I have been attending the Save Indian Family Network Ngo’s National meet since 2009 when the first meet was held in Goa, followed by Shimla, Kolkata, Bangalore, Nagpur, Agra and this time at Mumbai.

Witness how the same had evolved over the years and growing how more and more NGo started working for men coming forward  and showing their concerns about distressed and abused men of India , which had been ignored by decades in spite men suicide is double than women, accident , murder , cancer , heart attack of men always outnumbered than women.

Every conference had given us 2 or 3 surprise insight along with our traditional Brain storms, concerns; idea sharing by various chapters, future threats etc and the Mumbai Conference also was not an exception.

  • Live Press Conference:

This time the conference was started with a real press conference as the same was requested by some media houses and radical feminist journalist groups and we take that challenge and faced their all anti-men questions.

The press conference was not only for journalist , it provided many in sight to 180 activist from all over India , how to deal with journalist's Question related to off-topic, unrelated than real cause .

The press conference given opportunity to highlight some of our key success stories, concern, demands along with out of topic question , handling of journalist.

It was like a practical training Course for every activist, how to face press journalist. One need to have full knowledge of overall History of suffering of men and the same must be presented with backed up data, stories, logic along with your emotions.

Choice of words is the key while reply to uncomfortable question of Journalist like why few women join Men rights movement in spite we help them, when they call us  to help to their brother, son, friends, fathers or even Husband  get trapped in false cases like rape498a, work place harassment laws , etc.

There ate enough number of women associated with us to provide their helping hands to us when needed, but it’s you as men or women first have to recognize, harassment to other men is not funny or joke. They also deserve protection, support , as Men suicide is increasing year after year due to your own Misandric- male hater attitude.

It’s a movement and network for men NGO to bring in notice to common people of India how the suffering, abuse, Indian constitution article 21live & liberty, dignified life of a man had been denied via anti-men, unfair law & polices by Governments.  It’s about men’s right which is also human rights.

As an example:

Search in Google , more than 90% article written about amen’s issue are women Journalist.

Search in YouTube Video, electronic media anchors who sown some concern for men’s issue more than 70% are women anchors.

But more than 70% male anchors display their extreme Misandric-male haters mind set without any shame.

So it’s time to alpha Men to first wake up from Misandric mind set, than counting the head numbers of Women in Men’s conference.

It’s like if someone believe Earth is flat, you can’t change his/her perception as what he/she witness in bare eye the earth is flat only. One need to show him/her with evidence, logic, studies Earth is not Flat , it’s actually round , which you can’t see in your bare eye.

  • Summarized Video of Activity: Year 2014-2015:

The same followed by a wonder summarized impact-full one hour video of all Chapters /Groups/ NGOs activity in 2014 to 2015, which was crisp, interesting and very motivating for all to take forward the good works for next year’s also and reach new mile stones.

Many views were the same should have been started before start Press conference than after leaving the journalist. But keeping in mind the valuable time of journalist the organizers prefer to not waste their time, as the same was to motivate to activist, who are going to work on field not the media Journalist.

  • Interview of Media Editors:

Two Media editors as Guest were interviewed by MRA to understand their perception & suggestions about the movement’s success and failures. Key concerns like why men’s suffering and their abuse does not get sufficient space in electronic and print media brought to their notice also.

It had been witness though the concern of men and their suffering had get some noticeable space in Print media compared to 10 years back, but the electronic media still one denial mode.

As per editors the allegations media are biased or anti-men may not be true, except few editors or Journalist sitting in a ladder in any specific organizations. The key of their reporting’s depend on viewer-ship and readership only.  The type of issue and stories they carries, which viewers or readers want to know.

It’s a fact we Indian men or women are victim of Misandric mind set , so we love to view or read a rape stories with more interest ( let it be false or true ) than a story like suffering of men like Gopal Shettey , who had spend 7 years in jail in a fake rape-cases.

It’s we love to shame and disclose the identity of a men on the mere allegations or FIR or Charge sheet , than shame or disclose the identity of a person after the final verdict who was wrong let the case false or true .

The final verdicts of any cases let it be true or false does not give any suspense to readers or viewers but a allegations or FIR or Charge sheet keep every viewers or readers under suspense , what will be the final outcome of the case which is not known to them .

So, it is expected in today’s competitive world, media will be interested to more on un-decided cases than decided court verdicts.

  • 76% men found not found guilty in rape cases, more than 90% men found not guilty in Dowry cases (498A), but such order/story does not give any fantasy to viewers as there is no suspense.

But when women make any allegations against men, such stories have more viewer-ship or readership, as there is suspense and thrill, fantasy available, result we see out of 100 stories 98 will be allegations based and hardly 1 or 2 will be final court verdict based.

Unfortunately in Final verdict of Court Men outnumbered women but men failed to outnumbered women on creating allegations based FIR or complaint and as viewers or readers want allegations based suspense, lead media to give more space to women’s allegations than court verdict based story.

  • Now the question comes is it fair to shame a person on mere allegations without court verdicts by disclosing the identity of accused? Is not our constitution says, a person is innocent till proven guilty?

As per editors our present law there is no restrictions on that, when the accused is men and its police disclose the identity of accused and lead to media trail. Along with that tooth less defamation and damage law of our country lead to such media trails and promote to term a person Guilty on mere allegations.

One of editor agreed and promise to support for urgent need of a law to protect the identify of accused also till the court final verdict comes and the necessary bill must be placed in parliament with all statistics and case studies.

The activist’s teams present total 10 Topics related to need of the movement, help line performance, suffering of men in India.

Every topic ended with feedback panel summaries the same and determines some key actionable strategy for all chapters and groups working for men well fare.

Resolution Passed:

  • The conference end with pass a resolution and maximum member’s agreed by massive voice vote.

The 7th SIF (Save Indian Family) National Meet, held in Mumbai, was attended by more than 175 activists from across the country representing 50 NGOs. It was two days of rigorous brainstorming session and the following resolutions were passed and signed by the representatives.

These resolutions are to be submitted to The Prime Minister of India for necessary future steps to be taken by the Government of India.

1.    India should have a “Commission for Men”.

4.    Effective counselling and helpline for distressed and abused men to reduce men’s suicide.

5.    Amendments of CrPC 340 and IPC 182 to punish misuse of laws as these present laws are ineffective.

6.    Protection of identity of accused person. Merely on an allegation, the identity of the accused should not be revealed to the media.

7.    In all gender biased laws, the terms ‘Man’ and ‘Woman’ should be replaced by the term ‘Person’ and also the terms ‘Husband’ and ‘Wife’ should be replaced by the term ‘Spouse’.

8.    Government should have separate funds and create policies to rehabilitate survivors of false cases.

The conference end with proposal for SIF- 8th National Meet conference of Men right’s activist will be held in South regions on 15th Aug, 2016 and the organize team will be SIF-Hyderabad.

A group was started in 2005 from a small yahoo group called “Save Indian Family”, one may love it or hate it, but can’t be ignored any more .

NGO for Men: Why suicide Increases, when boy became Men?

In a press release issued by coalition of various NGOs , like Save Family Foundation ,  working for abused and distressed men of India ask:

Why suicide Increase, when a boy became men after 18 years of age?

Boy became Men-after 18yrs Suicide Increase at Rapid Speed.

Up to 18 years the suicide of boy vs girl are more or less same. But one must wonder what get changed after 18 years the men suicide keeps increasing?

As the age increases, a boy getting to be termed as Men and they are becoming victim of all gender biased law as well by default along with there is no support system available, when they face any type of Domestic abuse like verbal, emotional, sexual or economical abuse. There is no protection of men in present Domestic Violence act. With the increasing ages Men are getting more victims of blackmailing, extortion and domestic abuses which witness clearly from the suicide data.

This Independence Day, group of 50 Ngo’s and 180 activists across nation will assemble in Mumbai to brainstorm advocacy of gender neutral laws in their 7th National Meet.

The seventh national confluence has been earmarked to evolve with strategy of protecting vulnerable men from laws facing undue harassment due to heavily loaded legal provisions against men. It’s ironical that “India” presumed to be a patriarchal society has marginalized men like never before.   Apart from gender neutral laws the group will also discuss the concerning issue of suicide of men & deteriorating health status and lack of medical facilities for men & boys.

Husband Suicide vs Wives is 2.6 Times More

Suicides is one avenue which exhibits the social trauma and mental status of a men NCRB 2014 illustrates the vulnerable situation men are facing in present scenario.

Every 5.9 min a men is committing suicide in India with family disputes as single largest reason of male suicide. As per the latest statistics from NCRB, we wish to highlight following:

Ø  As against last year ratio of 2.17 Husband Suicide per Wife Suicide in India, in 2014, the ratio has increased to 2.21 Husband Suicide per Wife Suicide. Similarly, Male Suicide to Female Suicide ratio has increased from 2.05 last year to 2.10 in 2014. This means that with the Anti-Men environment in India, more Men and Husbands are forced to commit suicide. India, indeed, is becoming unsafe for men.

Ø  In India, 1 male commits suicide every 5.9 minutes in 2014. While Women suicide is 1 in every 12.36 minutes. Unfortunately, still Government is not showing any intent to bring equality for Men in Law. In 2014, India witnessed Male Suicide (89129), Husband Suicide (59744), Female Suicide (42521) while least was Wife Suicide (27064).

Ø  Another startling fact is that suicide of women in age-group 30-60 years is 39% of total women suicide while the same for men is 16% Higher & is 55%. This clearly shows that the age group of 30-60 years is 16% more vulnerable for men as compared to women. It is pertinent to mention here that this is the age group which is contributing maximum to GDP of India and hence government’s loss of focus to men of this age groups specifically will have a direct effect on the GDP of the country.

Ø  Another clear indicator of how growing to be an Adult male in India is crime is showing in the NCRB 2014 data. Till the age of 18 years, for every 100 suicides, boys and girls have almost equal proportions. The moment a boy becomes a man, i.e. of every 100 suicides of adults in India, 2/3rd of the suicides are by Male. This is clearly arriving to the fact that since POCSO is Gender Neutral (and other laws are too), the suicide ratio is almost same irrespective of Gender. The moment laws become biased, male suicide sky-rockets by another 25%-28%. Means, women are safer in Husband’s house whereas Men are unsafe once they become adult.

Ø  It is ironical that Ministry of Women and Child Development, in their own report in 2007 had said that of every 100 children sexually abused, 53 are boys but still the Rape laws of India or other laws do not cover men as victims because of which we see a huge increase of Suicide of Male gender the moment they become adult. The suicides are because of either false rape case threats or because of them being victims of Rape by women and no law covers them.

Ø  Cannot be directly established but indeed in 2013-2014, Men in India did see some relief with launch of SIF One (National helpline for Men – 8882498498) and also the directions from Hon’ble Supreme Court in ‘Arnesh Kumar vs State of Bihar’ gave a huge hope to Husbands / Married men and that’s where we are pleased to see their suicide rate coming down.

Ø  As per the Accidental deaths (by unnatural causes) data of NCRB 2014, 80% of victims are Men but still the Government is no waking up to make workplace, society, public areas, homes safer for men.

Ø  More than 85% of Traffic Deaths and over 81% of Traffic injuries victims are Men and still the Government is ignoring men completely in their policies and their budgets.

Single largest reason as revealed by NCRB for suicides were found to be family disputes (21.7%).

Cause of Suicide

The Confluence of activist will discuss the expansion of SIF one helpline to various other states.

Presently the helpline is operational in 10 States of the country namely MP-CG, UP, Delhi, Karnataka, Rajasthan, Maharashtra, West Bengal. The Non sponsored non funded helpline is a Single helpline service run by by self supported, self volunteers 24X7 to counsel and guide men in distress.

The grim scenario of men facing atrocities is a black spot as India when it is assumed to be a male dominated society where men even lack basic amenities as gender neutral laws and distress centers.

Single largest reason as revealed by NCRB~ for committing suicide 21.7 % are family disputes. 18623 male & 9977 females committed suicides because of family problems. Followed by illness 18.0% marriage related issues rank third with 5.1% love affairs 3.2% drug addiction 2.8%. The unsympathizing attitude of government & investigating authorities is exhibited from the fact that 12.4% of suicides have causes unknown.

Men are completely on a barren land in case of any disputes with any female in family, work place or at Social Network. It’s the Men have to pay heavy price even without any fault at their end.

65 crore male population does not have a law to protect themselves in case they face cruelty or any form of Domestic abuse. Studies report that male child Sexual abuse is 15% more than female child yet the laws remain biased to protect girl child alone. Amendment in various laws to protect women fails to protect men under similar scenario of molestation & sexual abuse. The forum will formalize a strategic group to create legal sensitization and seek constitutional amendments and urge lawmaking authorities to enroll men in the frame work of laws to protect interest of men.

Absence of a dedicated “Men Welfare ministry” explains gender Apartheid and men even facing poor health condition and medical aid also. Out of Illness 16078 men & 7663 women committed suicide. Aids forced 184 men & 48 women to suicide.

Men are more also prone to various forms of cancer, 407 men & 175 women chose to death.
Mental illness also engulfed 4761 men & 2341 women. Other prolonged illness sucked 10425 men & 4992 women to death.

Paralysis cased male suicide 3 times that of women. 407 men & 175 men committed suicide because of paralysis.

Where men are prone to illness & health hazards Indian men don’t receive any respite in the so called male dominated society.

“The Forum in this national confluence will evolve with a strategy to create pressure groups to sensitize parliamentarians to evolve with a time line & concrete plan to address male specific heath issues” , Said by one of activist from Mumbai.

Men overburdened with the social expectation of providing & protecting their families and society face larger social trauma.

Bankruptcy took away 2098 men vis a vis 210 women almost 10 times that of women showing men the sole breadwinner could not take the trauma. Poverty adhered 1419 men & 280 women, unemployment 1965 & 242 women.

Thus strengthening the fact that men are more vulnerable to social stigma and unable to meet the expectation of family & society succumbed to death.

·         To evolve a consensus from nationwide volunteers to evolve with strategic initiatives to empathize with the deteriorating situation of men in legal front, heath care & Social Status.

·         To address men in distress through various channels, campaign, create pressure groups and establish the respect for men.

·         To avoid the inevitable & stand by all Men to address their pain n support them for better living.

·         To restore the dignity of men & give them equality in true sense by respecting Indian Constitution article 21 – right to Live and Liberty to all.

Facing False IPC498A, rape, dowry, molestation, DV case, how to fight back?

Before start you must know the basic of criminal justice system:

Cases WIN or lost depend on ground contradictory statements, creating doubt against any allegations, abuse the process of LAW or for coming to court with unclean hands is the major key factor.

Go through all FIR/ Complaint/ Charge sheet or any other cases documents, then note down the contradictory statements, hiding of Important Fact.

On Facts of cases, prepare the questions for complainant and witness for Cross.
Bring out the fact in court and also try to find reference Judgments of SC or HC like your cases.

Use of CrPC 340 should not be missed at any stage, let judge dismiss it or keep pending for trial to end.

90% preparation should be from your side, as you know the fact better than your lawyers.

Avoid any contradictory statements or allegations without evidence from your side.

Highlight all the good things you have done for her, like purchase of any items / home / FD / education / photos of outings etc.

Identify the motive of her filling such cases, MOST IMPORTANT.

  • Never ever try to close the Complaint at Police station:

We have witness many cases, people think such cases can be closed by police station itself by compromise or a simple apology etc. The fact such cases are non-compoundable and non-cognizable and as per Complaint if the allegations levelled revel cognizable offence, police have no option but to register the FIR, let the allegation fake or you have evidence to prove it wrong.

So, don’t waste money and time to stop conversion of complaint to FIR. Your job starts once FIR get registered , then try to close the FIR by providing any evidence you have to Investigation officer to file final closer reports to court. Wherever without FIR police had tried to close the complaint, the accused had faced much trouble. Any type of compromise dead or apology etc will be used to file second time Complaint with stronger prima face evidence and none will be able to save you.

  • No self confession at Police stations or in Court:

Anything you say WILL be used against you, what you do not consider a "confession" police or social workers are likely to. Never try to explain why you have done this for her to help or come out form depression, learn from Sooraj Panchali case. It will be used against you as prima face evidence to build the case and the same act done for  good intention or bad intention up to court to decide and you will be dragged in court room years after years.

When we go through various judgments of Supreme Court of India witness more than 90% cases  where ever some men failed to prove their innocence, it is due to the self confession by accused was the prime reason for his convection.

We have seen many thousands of cases that would never have seen a courtroom had it not been for the things the accused said that were twisted into being a confession.

REMAIN SILENT! You HAVE that right, USE IT!

Yes police will try their best to play good and bad cope to get your confession by hook or crook, but always remember those are temporary torture, mentally prepare to face it.

  • Demand advocate to be present

If you demand an advocate, and you cannot afford one, police can’t continue to question you if you want one appointed free for you. If they persist they risk contaminating a case.

They have to produce you in court and that time seeks again an advocate and brings the truth of their physical torture if any.

You have to understand the level of Trouble you are going to face.

  • Finding the right advocate or LAW firm to represent you

There are many good advocates available, but that does not grantee hiring a good advocate will save you. There is nothing called good or bad advocate, it is how you and he make the relationship and understand each other’s requirement, start form fees to your capacity to pay.

Always avoid negotiating with advocate about their fees, asking their fees and if you can afford it go with it or avoid. It’s always better to fix fees per date than one time amount, it is a win win situation for both keeping in mind our Indian judiciary’s back log of cases.

First you have to understand the meaning of advocate. In legal terms he is representative of you. Why you need a representative for you? The reason is you have faced such cases first time, but an advocate witnesses such cases many times, so some experience he had which you don’t have.

Maximum cases we witness people run behind costly advocates and end up with a situation, instead the advocate represent him, he became representative of advocate.

It is often best to find the best advocate reference from the various court judgements where they had past experience of success.

If at all you don’t find a suitable advocate for your case as per your budget, it is better to fight as party –in-person than try to find a re-negotiated advocate.

It’s time to start update your own knowledge. You might have seen in movies, how an honest advocate brings all the evidences or witness in court room and in last minute turn the table.

But in reality it does not happen. 90% hard work, like collecting evidence, protecting your defence, you have to do it. Your advocate job to make the same in legal language and his job is only 10%. To understand various Law and judgements one need maximum 3 months for an average IQ guy, as it is not a rocket science.

The more you will start reading various SC or HC judgements, you will find more loop hole in your FIR or in her statements.

You can select any one as advocate to represent you, but should never rely solely on anyone, not even yourself. You must start to meet others who also facing such cases learn from their success and failure story. You can't help to defend yourself from a place of ignorance. You'll need to educate yourself on the subject area of the allegations you are facing.

When your advocate tells you that you need to do "X" it is important that you understand why you need to do that. Lots of time can be wasted trying to explain every step to you, and often the effort spent "selling" you on the need to do "X" or "Y" becomes so tiresome that anyone will decide to stop trying.

You need to understand why the things are necessary and not just be a cash cow and a passenger along for the ride. The best results come from a fully involved advocate and client relationship.
Many advocates don't like that, but the successful ones demand it. Beware and don't snatch defeat out of the jaws of victory.

  • Build your resources, may have to look for some Loan

No one wants to hear that this kind of case will be expensive and takes long time. Actually such cases had been filed against you keeping in mind that only. On the fear of arrest, on the fear of social reputation, on the fear of cases will drag years after years, you will surrender to their illegal demands.

If you had faced such cases, as your earlier brothers also done the same mistakes by surrendering in front them, it’s called Legal Terrorism. So, first you have to mentally prepare what ever happened to me already happened, but will not allow her to bite another innocent and for that if required will sell my own body parts also , but will not surrender in blackmailing or extortion.

Then only you will able to take right steps.

  • You have to begin by realizing the level of trouble you are in

Understand the consequences if you underestimate the legal ramifications for your life lead you to make the wrong decisions. Unfortunately most people go into some level of denial and minimize the trouble they are in. As a consequence they fail to do things they must and find themselves in much deeper legal troubles than they started out with.

For an example, say child sexual abuse allegations or sexual abuse to wife had been added during a divorce case, and you feel they mean little as how can such allegations to be taken seriously by court or your advocate says "such cases does not stand in court" . So you prefer to take such allegations lightly and ignore to concentrate to break their allegations and then find in no man’s land during trial. If you had reacted properly the eventual cost would be a fraction of what it will cost if things get out of hand.

You must start learning various technological product like , CCTV, SPY Cameras , good recording device for Mobile Phone , latest voice recording software , as during the process of all investigation, you may en-countered many threat , blackmailing , extortion demand . Don't loose the opportunity to capture the same always keep safe the original .

  • Avoid running away from court date:

We know maximum people hate to attend the court date, but the fact is as per criminal law, as an accused you are suppose to be present in court date. If you unable to present an exemption must be filed. But maximum cases we witness, when judge call, neither accused or advocate present and opposite party take un-due advantages to issue NBW and again you have to run form pillar to post and loose all advantages of your hard earned earlier bail or AB.

  • Start working with witness list:

You will need to start working on lit of witness. Include the people's name, addresses, phone information, as well as their employment and a brief biography. And also a brief bit on what they can testify to. Many time seen the witness you think is not important became key witness in your case.

You know best your case, so first identify truthfulness of witness and concentrate to bring truth in court room via cross exemptions. So, don’t limit yourself on one or two witness, use bad witnesses as well as ones on your side all, bring them in court notice. Let us decide who is important and who isn't. Witnesses are key evidence in any criminal cases fate. Always insist first all evidence of all wittness completed then only cross should start . Otherwise depend on your cross other wittness may add more aligation. If judge do not agree file application under CRPC 242/3 , let judge reject it at least it will help in higher court the evidence was after thought.

  • Prepare for Final arguments:

Depending on FIR, Charge sheet, Witness statements, you have made the question of cross exemptions and your aim to get maximum contradictory statements, creating doubt against any allegations, abuse the process of LAW or for coming to court with unclean hands.

Summaries all and Present all the same, preferably as written statements.

Enclose some SC or HC judgements if any, same like your cases.

Prepare yourself to fight Up to Sc than surrender against any Legal Terrorism.

90% is your mental battle and 10% is legal battle in all such cases. Start networking with people in advance than crying foul after wards and keep blaming, advocates and judges as biased.

All are suppose to be behave as biased ( the way you also was till you got hit by any false cases in India )  as law itself is biased on assumption that a women never lie or  a women never cheat .
