How to stop Legal Genocide of Indian Men?



#Unfairlaw or Policy can not bring Fairness in any Society, it only kills fairness in Justice System and harmony in Society.

 

The topic of the legal challenges faced by men in India, particularly in the context of gender-based laws, is a complex and sensitive issue. Some individuals have raised concerns about what they describe as the "legal genocide" of men, particularly in relation to laws that they feel disproportionately affect men, such as those regarding dowry harassment (Section 498A of the Indian Penal Code), false rape allegations, and child custody disputes. 

However, it's important to address this matter from a balanced perspective, considering both the protection of men's rights and the need for gender equity.

Here are a few ways the issue might be discussed and addressed:

1. Reform of Gender Bias in Laws

  • Review of Section 498A (Dowry Harassment Law): Supreme Court of India argued multiple times that this law, while aimed at protecting women from dowry-related harassment, is often misused, leading to unjust consequences for men. Reforms that ensure better scrutiny of cases, as well as proper checks and balances, could be explored.
  • Balanced Laws in Family Courts: Custody battles and divorce cases often have gender biases, with women sometimes given preference in child custody, regardless of the father's situation. Family courts should aim for fairness and evaluate each case independently, based on the best interests of the child, without gender bias.

2. Education and Awareness

  • Raising Awareness of Men’s Rights: There is a need for campaigns and educational programs that raise awareness about men's rights, particularly in relation to family law, domestic violence, and false accusations. This could help remove stereotypes and ensure that both genders are treated fairly.
  • Gender-Sensitive Approaches: Promoting gender equality doesn't just mean focusing on women's issues but also addressing the challenges faced by men. Gender sensitivity training for police, legal professionals, and others can help them approach cases with impartiality.

3. Support Systems for Men

  • Establishing Support Networks: There are relatively few support systems for men in distress in India, especially when dealing with family-related issues, false accusations, or mental health. Creating more avenues for emotional, legal, and psychological support for men could provide a way to address these issues effectively.
  • Men's Helplines and Advocacy Groups: Advocacy groups that focus on men’s rights can play an important role in offering legal assistance, psychological counseling, and support in situations where men may be unfairly treated.

4. Preventing False Allegations

  • Stronger Legal Framework Against False Accusations: While laws like 498A and those related to sexual assault have been created to protect women, there are concerns about their misuse. Providing legal safeguards against false accusations and ensuring strict penalties for malicious intent could help balance the scales.
  • Objective Investigations: Law enforcement agencies and courts should prioritize objective and fair investigations to prevent wrongful convictions and ensure that the rights of the accused, whether male or female, are protected.

5. Public Discourse and Dialogue

  • Open and Constructive Conversations: Societal attitudes towards gender roles and gender-based violence can be difficult to change. Promoting open discussions about the challenges men face, while also addressing women’s issues, is crucial. This could lead to better understanding and a more equitable legal system.
  • Media Representation: The media has the power to influence public perception. Encouraging responsible and fair representation of both genders in issues of law and family dynamics can help promote gender equality.

6. Comprehensive Legal Reform

  • Revision of Laws for Gender Neutrality: A reformation of laws to ensure they are gender-neutral could be a long-term solution. This would involve crafting policies and laws that don't disproportionately benefit one gender over the other but instead focus on the merit of the case at hand.
  • Establishment of Gender-Equal Standards in Law: A thorough analysis of the impact of existing laws on both men and women, coupled with a focus on fair justice, can help avoid potential biases in legal processes.

7. Mental Health Support and Wellbeing

  • Promoting Mental Health Care: Men’s mental health often goes underreported, especially in the context of legal struggles. Addressing emotional and psychological issues in a healthy and supportive way can prevent negative outcomes, such as suicide rates among men.
  • Societal Support: A shift in societal expectations, which often encourage men to remain silent about their struggles, can play a significant role in alleviating these issues.


In summary, while laws are necessary to protect individuals from abuse, ensuring that these laws are applied fairly to both men and women is essential. Gender biases should be minimized, and legal systems should focus on justice and the specific details of each case.

Discussions around men's Constitutional right Article 21- Live and Liberty with Dignity should emphasize a balanced approach that upholds justice for all genders.

A #FalseNarrative Created by Indian #WomenActivist : Indian Husband Rape their wife & Not Punished !

#YellowJournalism at Best:  There's a false narrative being created by so called women's rights activists in India which is also being supported by Media Houses.



The narrative is that Indian Husbands do forced sex with their wives without consent and go scot FREE. They never question when wife does forced sex with her husband against his will or consent, is wife termed as a Rapist?


The logic which is given is that in modern days marriage is based on equal partnership hence wife’s  will or consent is to be respected like an unmarried woman irrespective . Further  a married woman’s right to say No to sexual relationship is being compared to that of a Sex worker  right to say No to customer.

Fact is that India has already criminalized forced sex (#MaritalRape) with wife by Husband and provided laws such as #IPC498A & #DVAct to protect wife and punish not only husband, his relatives too. But the same protection has not been accorded to any Indian Husband as the laws are gender specific.


Forget about Sex if any Husband even Kisses his wife without her consent Husband can be sent to jail on mere verbal allegation by wife & no evidence required in #IPC498A for an FIR against family.


In #DVAct, husband can be thrown out from his Home on mere allegation by wife that husband had forced Sex with her and husband’s family is collateral damage. She gets protection order & on her single testimony husband can be sent to jail in the name of breach of protection order. 


In #CrPC125,  a Husband is asked to beg, brow or steal but he even has to pay his divorced wife or working wife till she's alive or she gets remarried as per recent precedents, irrespective if the breakdown of marriage is due to his or her fault.

As per #NCRB-2020 Suicide data, Husband suicide is 73093 whereas Wives suicide is 28085.

Have Judiciary or Law makers made any effort or action plan how to reduce Husband Suicide in Last 75 years? 

Just a group of elite Men & Women are desperate to term Husband a Rapist for their own self-interest, nothing else !


When a wife does forced sex with her Husband without his will or consent, they will never term the wife a #Rapist. Why the will or consent of Husband should not respected by law makers/society should also be the question? 


No one will understand the violation of Men's Constitutional rights  under Article14, Equality before law & equal protection by law to all citizens irrespective of gender and Article 21, Life, Liberty & Dignity of a person.


The burning question is that why Man  should marry at all with Indian woman when he knows marriage would give wife a #RedCard, which she can use any time and term him a #Rapist and he does not even have a #YellowCard in marriage. 

As a result #MarriageStrike is the only option for common man in India till the law makers, judiciary and society  do not take corrective action to make modern day marriage in India too as equal partnership in true sense and replace the word husband/wife to spouse in every law related to marriage relationship.

1.18 Crore Men Missing in India over past 4 years: NFHS-5






NFHS i.e. National Family Health Survey is conducted by IIPS along with other groups designated by Ministry of Health & Family Welfare (MoHFW) and is funded by USAID, UNICEF. Till date, 5 such surveys have been done and much of the reliance is placed by the Indian law makers on the NHFS data, when it comes to “assuming” about the ground realities.

 

The latest survey, NFHS-5 was done over 2019-2021 and recently some key highlights were published. The key findings are available on the NFHS website but we wish to draw the attention towards what was either ignored or celebrated big time to cover up the biggest “GENDER-SCAM” of India.

 

CRITICAL POINTERS:

Ø  Sex Ratio (Female to Male) in NFHS-5 has become 1020 women over 1000 Men. In NFHS-4 (2015-2016), the same ratio was 991. So there is an increase of almost 3% i.e. 29/1000.

This is the celebration that most Feminist theory appeasers are having.

Ø  Sex Ratio at birth increased 1% i.e. from 919 from 929 female over 1000 male from NFHS-4 to NFHS-5.

 

So, while there are only 10 additional births of females, but there are 29 lesser males from total population thus bringing the total differential of about 19 (i.e 1.9%) extra males less over past 4 years (gap between the NFHS4 & 5). Even if we assume the total population to be same as Census 2011 of 62, 37, 24,248 total males, what we have lost is minimum 1,18, 50,760 i.e. minimum 1.18 Crore.


 

  • Ø  Population below 15 Years has fallen from 28.6% in NFHS-4 to 26.5% in NFHS-5. Which means, that as a country, we are getting older.

 

  • This also implies another derivation that the MISSING MEN of INDIA are mostly adults. The derivation also looks true, looking at the increase of suicides amongst men (Adults) as per NCRB (National Crime Records Bureau, Ministry of Home Affairs) data.

 

  • Ø  Percentage of Women who did 10 Years schooling has increased by 5.3% while for Men, it has increased by 3.1% only between NFHS-4 to NFHS-5.

 

This also shows how the school dropout rate of Male gender is much higher than the Female Gender. Most boys are subjected to child labour and the number keeps growing. This is why, we see a lesser growth of 10Y schooling amongst boys/Men. But then, no one will ask this question to the Ministry of Women & CHILD development or Ministry of Education.

 

  • Ø  Diabetes amongst Men is 15.6% as against 13.5% amongst Women as per NFHS-5.
  • Ø  High Blood Pressure in Men also stands at 24% as against 21.3% amongst Women.

 

Thus, the biggest killers in India i.e. the Cardiac Issues and Diabetes killed more men, than women. But Ministry of Health and Family Welfare will continue to ignore this killer effect on men.

 

Ø  Last but not the least, look at the Questionnaire of NFHS-5, which was a 96 page one for Women but just 38 page one for Men. So more so, that the questions about being victim of say Domestic Violence were NOT EVEN ASKED from Male gender, when there are various known cases, court observations around Men being victims of Domestic Violence. JUST THINK WHY?

  • Ø  Earlier when we send our suggestion to NHFS-4 to include the same question to #MenToo for Domestic Violence on Men, in written reply to us they said: It can’t be included at this stage as data module capturing software already finalised and our suggestion will be considered next time. But it looks intentionally the same has been avoid to hide the actual data of Domestic Violence on Men.

 


So, while NFHS has shown critical BIAS in its survey when done on either gender, the data shows very clear crimes that men are subjected to in the country by the society/laws/government. E.g.:

 

1.     There are more than 1.18 Crores of Men missing. These Missing men are combination of Male deaths in India, of which Suicides is a big component. As per NCRB, Family Issues are the biggest reason of Suicides. India forces over 1.08 lakh men to commit suicide every year & the number keeps growing (already 2.5 times to that of Women) but no effort made by Govt or Judiciary to reduce the same.

 

2.   Of these missing men, more are from ages of more than 15 years. But “11.8 MILLION INDIAN MEN MISSING” won’t be a campaign which will interest the world, as who cares about lives of Men?

 

3.    Boys School Dropout rate, Boys Child Labour Rate and Boys sexual assault rate doesn’t bother the society or the Government or the Law Makers. That’s why the Law Makers conveniently made Boys an easier target of sexual crimes by making changes to the Rape Law. Also, with stress on #Beti only, #Beta of India are bound to suffer.

 

4.       Men’s Health will continue to be ignored as probably Breast cancer has higher importance than Prostate cancer or Life of Women, Plants; Animals are of higher value of that of Men.

 

  Lastly, surveys like NFHS, which clearly scream of BIAS in their data selection and data collection will continue to be the basis of Law Making in India because CRIME AGAINST MEN will be ignored forever.

 

Hence, we strongly recommend following to the Government of India to:

 

  • 1.      Issue a National Helpline for Suicide Prevention only for Men & Boys
  • 2.      Form National Commission for Men to look into clear issues faced by Male gender
  • 3.      Separate Child ministry from WCD Ministry and make it as a separate Ministry
  • 4.   Boys Education, Boys Child Labour, Boys Sexual Assault, all need to get same priority as that for girls

 

NFHS must be directed to have a Gender Neutral survey questionnaire, process for data collection [there can always be sections which may not be applicable to the one being surveyed]
