CJI Must review SC Regressive Verdict on #MTPAct Linking with #MaritalRape : A Open Letter

 Respected Sir, 

Being a responsible , law and constitution of India, abiding citizen, forced me to write this letter for your kind consideration to review the order passed by #MiLord Chandrachud, As Bopanna and JB Pardiwala. 

It was a perfect case where SC had opportunity to balance between Pro-Choice & Pro-Life by ordering or framing guidelines regarding unwanted unborn child or born child , how to take care via Women and Child Ministry Funded NGO. 

But it's pain to see that Pro-Life take back seat and pro-Choice take front seat and allow to kill a unborn child up to 24 weeks. Would like to attach the unborn Child reference Photo of 20 weeks and 24 weeks for your ready reference.

To bring your kind notice, Law makers already increased the law full right to abortion in #MTPAct from 12weeks to 20 weeks to 24 weeks for special cases, for which no one even objected. They are not just a fotues, its a life already formed. 

That's the reason maximum country are going towards Pro-Life than Pro-Choice. It's against humanity to allow kill a unborn child , rather than protecting a help less life.

Why this Judgement should be termed regressive and to be reviewed : 

1. Up to 20 weeks a women have pro-choice to decide the unborn child , does 20 weeks not sufficient for a women to decide ? If not where is end? Even just before deliver the baby or after deliver of baby also a women can claim to kill the child as per Pro-Choice and inability to take care the child, will SC allow the same too? 

2. To kill a unborn child the bench seek government support to such women to ensure safe killing of unborn child , but failed to consider same Government support should had been asked for saving the unborn child life. This not unfair ?

3. In the present case and pray by a unmarried women , there was no marriage involved, there was no forced or rape involved , still #MiLords entered in married relationship, was not uncalled for? Even on various case we asked to stick with the case at hand, where as #MiLords take a decision out of case without giving any opportunity of hearing from Husband side . Is that not Unfair? 

4. When the Rape Law is clearing mentioned any sexual relationship between Husband and wife , neither party can term other partner a Rapist, still on what basis #MiLords consider #MaritalRape should be a ground in #MTPAct ? It not entering and disrespect the Law making Process and Law makers wisdom? Is that allowed?

5. Regarding #MaritalRape Law already Delhi High Court given Spilt verdict and presently the same pending at SC. We had been reminded on multiple occasion by honorable court not to comment on sub judice case, but here #MiLords themselves giving judgment on a sub judice matters in a case which are not even related to any forced sex or rape case.  Why it should not considered an attempted to influence the on going cases in other court ?

6. After this #MTPAct order, every abortion can be termed as rape or  forced sex as in the order itself mentioned there is no requirement of any prove the claim is true or false. Is that called natural Justice? 

7. Most dangerous Part of the order: A Women (including wives) no need to prove there was any forced sex or rape . Her own word to be considered as gospel truth & she allowed to kill Unborn Child as per her wish & whims. Was #MTPAct was made for that purpose? Is that not Unfair?

With my limited submission, humble request to consider review the present order and correct the order accordingly keeping in mind the pro-life and respect the Indian existing Law .

My Pray : 

1. #MTPAct should be respected for 20weeks as per law makers wisdom and in case of special case pro-Life to considered and necessary guidelines and responsibility to Govt funded NGO to be given.

2. #MaritalRape should be removed from the Judgment as the same was never prayed in this petition and neither any submission considered why law makers don't allowed to term any sex between Husband and Wife not to be termed Rape. They have provided alternative remedy for the same to be used.

3. If Judiciary enters in law making process, does not respect law makers wisdom, then when Law makers will enters in the judiciary , it will not to be good for any citizen of India.

A #FalseNarrative Created by Indian #WomenActivist : Indian Husband Rape their wife & Not Punished !

#YellowJournalism at Best:  There's a false narrative being created by so called women's rights activists in India which is also being supported by Media Houses.

The narrative is that Indian Husbands do forced sex with their wives without consent and go scot FREE. They never question when wife does forced sex with her husband against his will or consent, is wife termed as a Rapist?

The logic which is given is that in modern days marriage is based on equal partnership hence wife’s  will or consent is to be respected like an unmarried woman irrespective . Further  a married woman’s right to say No to sexual relationship is being compared to that of a Sex worker  right to say No to customer.

Fact is that India has already criminalized forced sex (#MaritalRape) with wife by Husband and provided laws such as #IPC498A & #DVAct to protect wife and punish not only husband, his relatives too. But the same protection has not been accorded to any Indian Husband as the laws are gender specific.

Forget about Sex if any Husband even Kisses his wife without her consent Husband can be sent to jail on mere verbal allegation by wife & no evidence required in #IPC498A for an FIR against family.

In #DVAct, husband can be thrown out from his Home on mere allegation by wife that husband had forced Sex with her and husband’s family is collateral damage. She gets protection order & on her single testimony husband can be sent to jail in the name of breach of protection order. 

In #CrPC125,  a Husband is asked to beg, brow or steal but he even has to pay his divorced wife or working wife till she's alive or she gets remarried as per recent precedents, irrespective if the breakdown of marriage is due to his or her fault.

As per #NCRB-2020 Suicide data, Husband suicide is 73093 whereas Wives suicide is 28085.

Have Judiciary or Law makers made any effort or action plan how to reduce Husband Suicide in Last 75 years? 

Just a group of elite Men & Women are desperate to term Husband a Rapist for their own self-interest, nothing else !

When a wife does forced sex with her Husband without his will or consent, they will never term the wife a #Rapist. Why the will or consent of Husband should not respected by law makers/society should also be the question? 

No one will understand the violation of Men's Constitutional rights  under Article14, Equality before law & equal protection by law to all citizens irrespective of gender and Article 21, Life, Liberty & Dignity of a person.

The burning question is that why Man  should marry at all with Indian woman when he knows marriage would give wife a #RedCard, which she can use any time and term him a #Rapist and he does not even have a #YellowCard in marriage. 

As a result #MarriageStrike is the only option for common man in India till the law makers, judiciary and society  do not take corrective action to make modern day marriage in India too as equal partnership in true sense and replace the word husband/wife to spouse in every law related to marriage relationship.

From the Child Hood I always wondered, why our Censer board of Movie asks the Directors to remove Love making seen as absence, but rape seen as need of the Film. The number of rape seen I have seen even in old 70’s movie outnumbered any good love making seen.

Thanks to our Misandry – Male hatred, from the History we used the word “rape” as heinous crime, having most strong Punishment Clauses and keep crying to make it more strong and keep amending the same to such a extent, that today to file a Rape cases, there is no need of any medical evidence, there is no need of time limit.

Mere verbal allegations of Rape and the man are behind the bar.  Time to time we have witness many Judgments from court, but we never agree to the need of making any correction to reduce #Fakecases.

We all used to believe all cases of rape like we used to see in Movie uncensored way only happen. Common men or a woman does not know:

The most important fact , a person after gone to Jail and after long trial like 7 or 10 years : 'Honourably acquitted, but honour can never be restored'

Anil, a property dealer from West Delhi, was last week honorably acquitted by a Delhi court in a rape case lodged by his sister-in-law following a long-pending monetary dispute. 

Even as the court acquitted him honorably, Anil says his “honor can never be restored”. “My life and my face in the society can never be the same. Only I know how I am alive. Accusation of rape is a punishment in itself, even if false,” he says.

This and many similar cases show a vast shift from the times when it was a common ground that no women would make false allegation of rape given the social stigma attached to it. 

I had able to meet many film makers, asked them several time, they are very active to rise many social issue by their movie, but why they shy to rise a so genuine issue of unfairness of Rape law?

 

Maximum time we get reply, it’s a women issue, and we can’t do that as a male feminist or female. 

 

Show them so many mails and call details, it is not only men issue. We get more than 70% call form women only in the form of Mother, sister, daughter, wives  for help as some one’s brother or father or husband or friend had been accused as rapist under the unfair clause of rape law. 

 

It’s not that only women abuse the rape law, for every fake cases filed by women, at least 2 or 3 men who are victim of Misandric Virus ( male hatred) Mindset cheers behind the seen.

 

But all goes in deaf ears as usual. But when I saw the trailer and heard about the movie called: Miss Tanakpur | Official Trailer | Annu Kapoor | Rahul Bagga ... it was known to me, their release will not be as smooth as they might have expected.

 

When a person is accused to rape to a Buffolo can go through all such trauma and suffering, one can understand when women #CryRape, what extend a man has to suffer.

 

The law is framed in such a way, neither Police or court can put in dustbin any fake rape cases, let he accused by Buffolo also.

 

Many country came out with progressive Legislation along with strong good will by Judiciary for strong punishment for fake cases, Rape test Kit to determine the same as positive or negative.

 

Many country made rape law gender neutral (if women don’t do rape why they should afraid), as UN-consented sex not only men, women also capable to do.

 

Yes, none can stop the Fake cases of rape nor any strong law will able to eliminate the crime called rape from society, but need the balance, sending some one behind bar mere verbal allegations is not Justice, it promotes injustice.

 

History witness, when somewhere Injustice happened, threat of Justice occurred everywhere.

 

I wish a grand success of movie Miss Tanakpur, which expose not only short coming of our unfair, biased assumption based rape law, it expose how our Police and Judiciary put fuel in fire in such cases.

 

Will be waiting when directors like Madhur Bhandakr will wake up and come out with some more true story of fake rape cases.

Will Youth ever try to remove Misandry (Male Hatered) ?

Manish( Name Changed to protect his identity ) a 25 years Bright Student of Delhi know every think about the LAW of Cricket, but totally unaware about India’s unfair, biased law like Rape, Dowry, #MaritalRape , Domestic Violence Act by which  one day he will be termed as Rapist for No fault at his end.

He was in a relationship with a Girl for 4 years but the Girl's family was not ready to accept him as Son-in-LAW, so they run away from home and got married. In return the Girl's parent file a Kidnapping and Rape case not only against him but drag all his family members like father, Brother, one close friend and married sisters also by claim they all supported her to Kidnapping the Girl.

His parents went to Jail and he had to surrender in Police station and was in police custody for 2 days and gets all treatment what is possible in Police custody. He keep repeating, he is not a Rapist, they are in relationship for last 4 years, but all go in deaf years.

At last he got the Bail from Court, but the tag of #Rapist put in his head will never go away so easily, but the girl prefer to go back to parents Home than support him and continue the married relationship.

Now the Police had closed the case and filed final reports to court it was not a rape case as both was married.

But after 3 months  the girls file, new cases under Domestic Violence and claiming residence Right of Girl's and maintenance 30K per month, one time compensations of 20 lacks.

They filed another case of 498A , with allegations that Manish refused to take her back and demanding 50 lacks as Dowry.

In a New twist she claim she had been Raped in married relationship also and every day Manish used to beat her and used to have forced sex, once he even hit him 18times in head for forced sex.

So, from a Rapist now he became Wife beater, Dowry seeker along with new term he rape his own Wife.

Once again court rejects her petitions as there was no frima face evidence and there was enough SMS, calls by her to Manish where she was asking to forget every think and let start fresh as married couple. But Manish had learnt enough and was very much hurt by the fact, for no fault why his parents and brother was send to jail? He can’t trust her 2^nd time, so best is get separated and let her start new life with some good guy than continue a relationship with a #Rapist.

Now the real Blow comes, her advocate refer a foreign funded women organizations who are desperate to send all men to Jail in #MatriaRape, the women organizations move to Supreme Court, but the SC also denied the Petition as she had already asked relief under Domestic Violence act, if there was any wrong done by Manish , he will be punished and have to pay the price under Domestic Violence act , 498A as well as Divorce with necessary alimony under section 25.

The same does not go well with Feminist groups and media Houses in India. They all geared up. By covering the face of Girls start playing the Victim Hood card and spread lie after lie that in India there is no relief to a wife if he faced #MatrialRape , so change the law.

They repeatedly hide the Vital information that in 2000 itself LAW commission made recommendation to make Rape related law like IPC375 , IPC376 should be Gender Neutral , so that irrespective men or women who ever do wrong should be Punished.

Now as a Indian men we are already full of misandary( Male Hatred) already in our mind , keep jumping in twitter and put our views how liberal we are without even knowing that 4 special law available in India fr a Wife if she face any #MaritalRape.

But the fact they also don't try to know, in India if a Husband rape his wife , she can seek relief under 4 special laws like Domestic Violence Act, CRPC125, 498A as well as Divorce. The truth is when wife do rape to Husband or to any other men in India, as per India LAW she had never punished. If the men try to tell the truth that he had been raped by women or raped by wife, instead of register any case against women/wife, the Rape cases registered against Men/Husband only.

 When a woman rapes (sex without mutual consent) our Indian Misandary( Male Hatred)  society and law colors the act with terms like loving or affectionate. Sadly some women consider such acts as their birth right over men. If a man tries to fight back or resist or even dreams of speaking the truth, he himself is labeled as rapist instead of being considered a Victim of rape.
